Town of Alashpee <br /> MASHPEE ZONING BOARD OF APPEALS 16 Great Neck Toad North. <br /> mV. 1 , c <br /> LE <br /> l�lashpee, Massachusetts 0N64.) <br /> Decision for a Special Permit <br /> RE: Thomas and Mariana Duncan 33 Shoestring Bay Road <br /> Map 84 Parcel 24 <br /> SP-04-31 <br /> A Petition was filed on January 30, 2004 for a Special Permit under Section 174- <br /> 25.I.9 of the Zoning By-laws to allow for construction of a pier, ramp and float on <br /> property located in an R-3 zoning district at 33 Shoestring Bay Road (Map 84 Parcel 24) <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on February 6, 2004 and <br /> February 13, 2004, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was scheduled on February 25, 2004 on the Petition at the <br /> Mashpee Town Hall but was heard on Wednesday, April 28, 2004 due to conservation <br /> issues at which time the following members of the Zoning Board of Appeals were present <br /> and acting throughout: Marshall Brem, James Regan and Robert Nelson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Peter Sullivan of Sullivan Engineering represents the Duncan's at this hearing. <br /> Petitioners are seeking a special permit to construct a pier, ramp and float. They have <br /> been approved by Conservation for a 6 x 25 foot float along with the other plans and <br /> Shellfish has approved them as well. After some initial confusion regarding the correct <br /> set of plans, the Board and Mr. Sullivan review the plans in detail. The Conservation <br /> Commission has approved these plans as well as the Shellfish Warden. The Board feels <br /> this is a reasonable request and all concerned commissions have signed off on the <br /> request. Marshall Brem moves to grant the Special Permit for the pier, ramp and float. <br /> Robert Nelson seconds the motion. <br />
