Notice was given by publication in The Mashpee Enterprise,
a newspaper of general circulation on January 23, 2004 and January 30, 2004, a copy of
which is attached hereto and made a part in the Town of Mashpee, on hereof.
A Public Hearing was held on the Petition at the Mashpee Town Hall on
Wednesday, February 25, 2004 at which time the following members of the Zoning
Board of Appeals were present and acting throughout: Robert Nelson, Marshall Brem
and James Regan.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of
Mashpee Zoning By-laws.
Michael Grotzke of The Phoenix Group represents petitioner for this hearing.
They are seeking a variance in order to build a garage and enlarge the entry area to the
family room. This will also increase the lot coverage. Due to the placement of the house,
they need relief from the front yard setback requirements because this is the only place
the garage can be put. The Board informs Mr. Grotzke that they do not like to see more
than 20% lot coverage and this is at 24%. Some discussion occurs as to other homes in
the area. The Board feels this is really the only way petitioner can build this. Mr. Nelson
