Mashpee Zoning Alan Brenner
Board of Appeals V-04-25
2
moves to grant a 19.5 foot variance from Popponesset Island Road. Mr. Brem seconds
the motion. All agree. So moved.
GENERAL FINDINGS
1. that the subject property is located at 95 Popponesset Island Road and
contains 13,504 square feet.
SPECIFIC FINDINGS
The Board determined that:
1. a literal enforcement of the By-laws would involve substantial hardship to
the petitioner.
2. Desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent or
purpose of the by-law.
In view of the foregoing, the Mashpee Zoning Board of Appeals found that the
Petitioner met the criteria necessary for the granting of a 19.5-foot and a 4% lot coverage
Variance. Upon motion duly made and seconded, the Zoning Board of Appeals voted
unanimously on February 25, 2004 to grant this to Petitioner. This variance is
conditioned upon plans from The Phoenix Group of Mashpee, MA, dated January 12,
2004, revised January 24, 2004, revised January 27, 2004
i e
aS t
