Mashpee Zoning
Board of Appeals Dry Harbor Enterprises
3 Owner: Andrew Conway
SP-04-26
the potential accidents that may occur due to the topography of Falmouth Road and a
large boat hauler trying to obtain access to the facility. The Board feels that a large boat
hauler on Falmouth Road will have a detrimental impact on the area Mr. Nelson informs
the applicant that he has met with Police Chief Rodney Collin and the Chief has laid out
the following suggestions:
There shall be a"right in—right out" form of egress constructed to enter the proposed
facility. The reasons for the recommendation are as follows:
■ The volume of traffic on Route 28 at the intersection of Wag's Road
■ Speed of traffic in the vicinity at the intersection of Route 28 and Wag's Road
■ The likelihood of tractors and/or trucks entering and exiting with trailers and
extended loads.
■ The likelihood of tractors and/or trucks entering and exiting with trailers and
extended loads having the inability for rapid acceleration to maneuver within said
intersection.
■ The potential for accidents as a result of tractors and/or trucks entering and
exiting with trailers and extended loads having the size and width that could
obscure vision/sight distance and by blocking a travel portion of the roadway in
an attempt to turn.
■ The environmental concern and potential explosive situation due to the likelihood
of full tanks of gasoline on boats being stored at such a facility.
This recommended traffic control regulation would result in northbound traffic on
Route 28 being able to turn right onto Wag's Road. In addition, southbound traffic on
Route 28 would be prohibited from turning left onto Wag's Road. Vehicles leaving
Wag's Road would be permitted to only turn right onto Route 28. Any and all vehicles
entering and/or exiting Wag's Road will not face an unreasonable hardship as a result of
utilizing the Industrial Road which will enable them to proceed onto Route 28 via a
traffic light and thus enhance safety of the motoring public.
The Board feels all of the recommendations that Chief Collins has made shall be
conditioned on the Special Permit. Also conditioned on the Special Permit are all the
necessary permits from Nstar and all of the requests from the Fire Department being met.
Marshall Brem moves to grant the special permit with the above-mentioned
conditions. Zella Elizenberry seconds the motion. Robert Nelson votes to deny. Eric
Dubliner votes in favor. Jonathan Furbush votes in favor. Motion is carried 4-1.
t
i
