Mashpee Zoning <br /> Board of Appeals Minutes <br /> 1 April 14, 2004 <br /> TOWN OF MASHPEE <br /> Zoning Board of Appeals <br /> Minutes - Wednesday, April 14, 2004 <br /> The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, April 14, <br /> 2004 at 7:00 P.M. at the Mashpee Town Hall. Board Members James Regan, Robert <br /> Nelson and Zella Elizenberry were present along with Associate Members Frederick <br /> Borgeson and Richard Guerrera. Associate Member Marshall Brem was absent. <br /> Chairman James Regan brought the meeting to order at 7:05 p.m. <br /> Robert Nelson read matters that were previously scheduled for this evening but were <br /> continued for various reasons. <br /> David Nailor: Requests a Special Permit from Section 174-25-H-9 of the Zoning By- <br /> laws to allow a two-way radio tower on property located in an I-1 zoning district at 67 <br /> Industrial Drive(Map 88 Parcel 25) Mashpee, MA. <br /> Sitting: James Regan, Zella Elizenberry and Robert Nelson. <br /> David Nailor is again before the Board regarding the installation of a 35-foot tower in <br /> order to utilize 2-way radio system for his business "The Comfort Man". Mr. Regan <br /> defers to Mr. Nelson's input regarding this matter. Robert Nelson had previously asked <br /> Mr. Nailor to continue his hearing so that he may have more time to further research the <br /> by-laws regarding radio towers. Mr. Nelson has informed Mr. Nailor that there is much <br /> gray area regarding the by-laws for this type of tower. Mr. Wheeler has indicated that <br /> since it is 35 and not more than 35 feet, it would be acceptable. Mr. Nelson inquired <br /> about what part of the property it would land on if it were to be blown down by hurricane <br /> winds—Mr. Nailor it would not actually land on his property, however, other towers like <br /> this one have withstood many high wind storms. No one in the audience has any <br /> problems with this tower. Mr. Nelson motions to grant the Special Permit for a 35-foot <br /> radio tower. Zella Elizenberry seconds the motion. All agree. So moved. <br /> Martin Ahearn: Requests a Special Permit from Section 174-25.A.8 of the Zoning By- <br /> laws to legalize an existing accessory structure on property located in an R-5 zoning <br /> district at 33 Winslow Drive (Map 71 Parcel 13 1) Mashpee, MA. <br /> Sitting: James Regan, Robert Nelson and Zella Elizenberry. <br /> Mr. Ahearn represented himself at this hearing. This had been previously continued from <br /> February due to applicant's health problems. He is seeking to legalize an existing <br /> apartment in his house. The Board reviews the plans and would like to see how the house <br />
