Mashpee Zoning <br /> Board of Appeals Minutes <br /> 2 April 14, 2004 <br /> is going to look with the approved structure. The plans they are looking at do not show <br /> how the main dwelling ties into the new one nor does is show the floor plans. Mr. <br /> • Ahearn agrees to give the Board a full set of plans to review. Mr. Nelson makes a motion <br /> to continue this matter until April 28, 2004. Zella Elizenbery seconds the motion. All <br /> agree. So moved. <br /> Kenneth Konikowski: Requests a Variance from Sections 174-31 and 174-33 of the <br /> Zoning By-laws to seek relief from the current sideline setbacks, front yard setbacks and <br /> distance to the wetlands setback requirements in order to construct a garage and additions <br /> to the main dwelling on property located in an R-3 zoning district at 95 Whippoorwill <br /> Circle (Map 125 Parcel), Mashpee. MA. <br /> Sitting: James Regan, Frederick Borgeson and Robert Nelson. <br /> Michael Grotzke, engineer for the Phoenix Group represents the petitioners at this <br /> hearing. This was continued from March 10 due to the fact that different sets of plans <br /> were filed with some of the departments. The Department of Health received plans from <br /> Mr. Grotzke's office on Wednesday, April 14t", the same day as the hearing. Mr. Regan <br /> informed Mr. Grotzke that Mr. Harrington is quite upset about plans being delivered at <br /> the last minute requiring his comments for a hearing on that evening, however, Mr. <br /> Harrington has submitted comments. There are still outstanding issues to be dealt with <br /> regarding the septic system accommodation v. number of bedrooms and floor plans are <br /> still needed per Mr. Harrington. The bedroom system must be straightened out before the <br /> Board will move forward with this matter. Mr. Nelson stated at the last hearing that all of <br /> • this must be done, and again Mr. Grotzke has not accommodated the Board of Health's <br /> requirements and to do so before he came back again. The Board is not comfortable <br /> making any decisions until the Health Agent has been satisfied. Mr. Grotzke asks the <br /> Board to consider acting on the variance tonight and condition the Board of Health issues <br /> —the Board will not act on anything without (1) a lot coverage percentage to be <br /> calculated and (2) comments from Mr. Wheeler; who was not at the meeting and (3) Mr. <br /> Harrington's approval on what is before the Board, regardless of whether or not it is a <br /> "Board of Health matter". The Board makes a motion to continue this matter until May <br /> 12, 2004. All agree. So moved. <br /> Michael J. Price: Requests a Special Permit under Section 174-25 (I)(9) of the Zoning <br /> By-laws in order to construct and license a pier, ramp and float on Popponesset Bay with <br /> maintenance and perpetuity on property located in an R-3 zoning district at 152 <br /> Popponesset Island Road (Map 112 Parcel 11) Mashpee, MA. <br /> Sitting: Robert Nelson, Zella Elizenberry and Richard Guerrera. James Regan steps <br /> down from this hearing. <br /> David Sanicki, of Cape & Islands Engineering, represents the petitioner. He is seeking a <br /> special permit to build a pier, ramp and float on Popponesset Bay. The Harbor Master <br /> has ok'd the plans since it has been brought in closer to the shore and does not obscure <br /> boat traffic.
