Mashpee Zoning <br /> Board of Appeals Minutes <br /> 4 April 14, 2004 <br /> Michael Grotzke of The Phoenix Group represents petitioner at this hearing. They are <br /> seeking to demolish the existing dwelling and rebuild a new home. Mr. Grotzke presents <br /> a set of plans to the Board mentioning that his client no longer needs a sideyard setback <br /> variance and they have changed the plans to reflect that. Mr. Regan asks Mr. Grotzke if <br /> these plans are different than the plans he originally submitted to the ZBA. Mr. Grotzke <br /> tells the Board that a direct abutter had issues with the need for variance and therefore the <br /> plans were changed to accommodate his requests and informs the Board that his client is <br /> only looking for a 19-foot variance to the wetlands. Mr. Regan was very disturbed that <br /> Mr. Grotzke presented one set of plans that half of the Board was reviewing and there <br /> was a completely different set of plans that were originally filed with the ZBA that the <br /> other board members were reviewing. Mr. Regan told Mr. Grotzke this was totally <br /> unacceptable and was wasting the Board's time. He was instructed to refile new plans <br /> and be sure everyone has the same thing. This matter was continued until May 12, 2004. <br /> All agree. So moved. <br /> Ralph Whittemore: Requests a Special Permit from Sections 174-25 (A.8) and <br /> 174.45.A of the Zoning By-laws in order to obtain accessory use on an existing detached <br /> dwelling on property located in an R-5 zoning district at 182 Main Street(Map 37 Parcel <br /> 140) Mashpee, MA. <br /> Sitting: James Regan, Zella Elizenberry and Frederick Bergeson. <br /> Mr. Whittemore represents himself at this hearing. He is seeking to build an accessory <br /> apartment above his barn on his property. He has over 4 acres of land and there are 2 <br /> separate dwellings on this property. The Board feels that this is a reasonable request <br /> since Mr. Whittemore wife's just died and his daughter is going to move in to help him. <br /> Zella Elizenberry moves to grant the special permit. Frederick Borgeson seconds the <br /> motion. All agree. So moved. <br /> Kyle M. Bugg: Requests a Variance from Sections 174-31 and 174-17 of the Zoning <br /> By-laws to vary the setback requirements and to alter a non-conforming stricture in order <br /> to build a 22' x 24' garage with a 30' x 6' farmer's porch on property located in an R-3 <br /> zoning district at 13 Cayuga Avenue (Map 65 Parcel 119G) Mashpee, MA. <br /> Sitting: James Regan, Zella Elizenberry and Robert Nelson. <br /> Kyle Bugg represents himself at this hearing. He is seeking a variance in order to build a <br /> garage and farmer's porch on his property. The Board of Health made a comment <br /> regarding "no habitable space" above the garage and he is planning to build a family <br /> room above it. The Board needs to clear up the word "habitable" whether they meant to <br /> say a bedroom or no space at all. Mr. Regan is not comfortable granting this until we <br /> have a clear understanding of this comment. Zella Elizenberry makes a motion to <br /> continue this matter until April 28t" until this can be cleared up. Mr. Nelson seconds the <br /> motion. All agree. So moved. <br /> • <br />
