Mashpee Zoning <br /> Board of Appeals Minutes <br /> 4 May 12, 2004 <br /> Leon Pinsonneault: Request a Special Permit from Section 174-20 of the Zoning By- <br /> Laws to demolish an existing dwelling and rebuild a new structure and accessory <br /> structure on property located in an R-5 zoning district at 7 Cranberry Avenue (Map 49 <br /> Parcel 134) Mashpee, MA. Owner of Record: Phillip M., Sandra& Morris Rothstein, <br /> Trustees of K&R Realty Trust <br /> Sitting: Marshall Brem, Robert Nelson and James Regan. <br /> Mr. David Sanicki of Cape & Islands Engineering represent the petitioner at this hearing. <br /> Petitioner is seeking a special permit to demolish the existing dwelling and have an <br /> accessory structure (not a bedroom) to be used as office space and a play room for his <br /> children. He is further seeking a 10- foot variance to the wetlands requirements for the <br /> house and a 27-foot variance to the wetlands for the accessory building. The Board <br /> views the plans and discusses the use of the accessory structure with the petitioner to be <br /> sure it is not being proposed to use as a bedroom. Mr. Pinsonneault wants this space for a <br /> shop and an office with the above space for a playroom for his young children. The <br /> Board feels this would be an improvement to the neighborhood especially with a new <br /> septic system. Marshall Brem moves to grant the special permit and a 10-foot variance <br /> on the house to the wetlands and a 27-foot variance for the accessory structure to the <br /> wetlands. Mr. Nelson seconds both motions. All agree. So moved. <br /> James and Rosemary Mitchell: Request a Special Permit under Section 174-25 (I)(9) <br /> of the Zoning By-laws in order to construct and license a pier, ramp and float on <br /> Popponesset Bay with maintenance and perpetuity on property located in an R-3 zoning <br /> district at 90 Popponesset Island Road (Map 106 Parcel.'4) Mashpee, MA <br /> James and Rosemary Mitchell: Request a Variance under Section 174-25 (I)(9) of the <br /> Zoning By-laws to exceed the 70' maximum from MHW for a pier and ramp on <br /> Popponesset Bay on property located in an R-3 zoning district at 90 Popponesset Island <br /> Road (Map 106 Parcel 34) Mashpee, MA. <br /> Sitting: Robert Nelson, Zella Elizenberry and Richard Guerrera. <br /> David Sanicki of Cape & Islands Engineering represents petitioner at this hearing. They <br /> are seeking a special permit to build a pier, ramp and float and a variance to exceed the <br /> 70 foot maximum length of the dock due to the shellfish officer's request so as to not <br /> interfere with the navigation pattern. Mr. Sanicki reviews the plans with the Board and <br /> informs them that Mr. York requested the dock be in at least 2 feet of water thereby <br /> making the dock length 18 feet beyond the 70 foot maximum. Mr. Brem remarks that the <br /> plans dated February 25, 2004 should be the referenced in the decision. <br /> Richard Mark: Requests a Special Permit under Section 174-25 L 9 of the Zoning By- <br /> Laws in order to license and maintain a wooden walkway and dock along the shore of <br /> Santuit Pond on property located in an R-5 zoning district at 45 Santuit Lane (Map 30 <br /> Parcel 4) Mashpee, MA. <br /> • <br />
