Mashpee Zoning <br /> Board of Appeals Minutes <br /> 5 May 12, 2004 <br /> Sitting: James Regan, Robert Nelson and Zella Elizenberry. <br /> David Sanicki of Cape & Islands Engineering represents the petitioner at this hearing. <br /> They are seeking to build a pier, ramp and float and have amnesty interim approval. <br /> There is a requirement that this home owner must get a new license since it is a change in <br /> ownership. The Conservation Commission requested new changes and to remove 12 feet <br /> of the deck on the north side, this will make the size of the structure to decrease and be <br /> further away from the neighbor's property. The Board references the plan dated May 5, <br /> 2004. Mr. Nelson moves to grant the special permit. Zella Elizenberry seconds the <br /> motion. All agree. So moved. <br /> STEVEN AND LESLEY GARRIGUS: Request a Variance from Section 174-31 of the <br /> Zoning By laws to vary the setback requirements in a cluster zone to build a 10' x 22' <br /> garage addition on property located in an R-5 zoning district at 46 Snead Drive (Map 67 <br /> Parcel 67) Mashpee, MA. <br /> Sitting: James Regan, Richard Guerrera and Robert Nelson. <br /> Architect Terry Luff represents petitioners at this hearing. They are seeking a variance in <br /> order to build a garage. The placement of the house makes it difficult to adhere to the <br /> current zoning and still expand the garage. The lot is also a corner lot and this places <br /> additional burden on the petitioner to meet two frontage setbacks. The garage doors will <br /> be facing Nelson Circle. The following abutters showed full support for the project: <br /> Bruce Willard <br /> 13 Nelson Circle <br /> Ron Wesgate <br /> 47 Snead Drive <br /> Gerald Douglas <br /> 54 Snead Drive <br /> Robert Gimany <br /> 14 Nelson Circle <br /> The board discusses with Mr. Luff the possibility of an address change due to the new <br /> location of the driveway and suggest they see the Town Clerk. Mr. Guerrera moves to <br /> grant a 4.7 foot variance. Robert Nelson seconds the motion. All agree. So moved. <br /> JANET LUFF: Requests a Special Permit under Section 174-45-4 of the Zoning By <br /> Laws in order to build an accessory apartment on property located in an R-3 zoning <br /> district at 31 Mohican Avenue (Map 72 Parcel 69A) Mashpee, MA <br /> Sitting: James Regan, Robert Nelson and Zella Elizenberry. <br />
