Mashpee Zoning
Board of Appeals Minutes
6 May 12, 2004
Mr. Terry Luff, Architect, represents petitioner at this hearing. She is seeking a special
permit for an accessory structure. Petitioner has gone through the Design Review
Committee and they feel the driveway is problematic, as does this Board. The parking is
not sufficient to accommodate up to 4 cars. Mr. Luff informs the Board they have no
problem changing the driveway to meet that requirement. They will re-draw plans to add
2 parking spaces. All fire codes must be met as well (this refers to the commercial fire
alarm system). Applicant agrees to all requests. He will drop off the new plans in the
next few days. Zella Elizenberry moves to grant the Special Permit. Robert Nelson
seconds the motion. All agree. So moved.
Frank and Kimberly Silva: Request a Special Permit from Section 174-25 GA, 174-
25G.7, 174-25.G.9 and 174-25.1.6 of the Zoning By-laws in order to conduct a business
that may include but is not limited to landscaping, wholesale and indoor and outdoor
storage on property located in an I-1 and R-3 zoning district at 129 Industrial Drive (Map
88 Parcel 30A) Mashpee, MA
Sitting: James Regan, Robert Nelson and Marshall Brem.
Attorney Laura Moynihan of Ament and Ament represents the petitioners. They are
seeking a special permit (original special permit SP-01-31 has expired)to build a
contractor's building for"Frank Silva Concrete Forms",petitioners business. They are
seeking some outdoor storage that will be in cages no more than 20 x 20 since these
things cannot be brought inside. Attorney Moynihan reviews the plans with the Board
and explains that Mr. Silva would like some office space and plans to run his business
between the hours of 7:00 am and 6:00 p.m. Design Review has approved these plans
and Attorney Moynihan tells the Board this property will be well buffered from the
abutting residential portion. The previous owner, Mr. Gary Tavares who was previously
granted the original special permit, fully supports the project. The Board feels this is
appropriate to the area and Marshall Brem moves to grant the special permit. Mr. Nelson
seconds the motion. All agree. So moved.
STEPHEN GIATRELIS: Requests a Special Permit under Section 174-25 (G) 4; 174-
25 (G) 5; 174-25 (G) 6; and 174-25 (G) 9 of the Zoning By laws for plumbing, electrical
or carpentry shop or other similar service or repair establishment, place for
manufacturing, assembly or packaging goods, wholesale business and storage in a roofed
structure, wholesale business and storage on property located in an 1-1 zoning district at
56 Nicoletta's Way (Map 26 Parcel 21) Mashpee, MA.
Sitting: Zella Elizenberry, James Regan and Robert Nelson.
John Slavinky of Cape & Islands Engineering represents the petitioner. He is seeking a
special permit in the industrial zone in order to build contractor bays. He is seeking a use
permit in order to have plumbing, electrical or carpentry shop or other similar service or
repair establishment, a place for manufacturing, assembly or packaging goods, a
wholesale business and storage in a roofed structure.
