tOA�_'N _ n of c 16 Great JNeck Pvoad NV rth <br /> lblash,pec, NI(Issaclatsetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Variance <br /> Re: Michael and Carol Atwill 12 Sachem Road <br /> Map 65 Parcel 68 <br /> V-04-72 <br /> A Petition was filed on April 27, 2004 for a Variance from Section 174-31 of the <br /> Zoning By-laws to vary the current setback requirements on property located in an R-5 <br /> zoning district at 12 Sachem Road (Map 65 Block 68) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation on May 7, 2004 and May 14, 2004, a copy of which is <br /> attached hereto and made a part in the Town of Mashpee, on hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, May 26, 2004 and continued until June 23, 2004, at which time the <br /> following members of the Zoning Board of Appeals were present and acting throughout: <br /> Robert Nelson, Marshall Brem and James Regan. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Atwill represents himself at this continued hearing. This matter was <br /> continued from the May 26"'hearing so that the petitioner could have his plans re-drawn <br /> for his wrap around porch that he is requesting a variance for. The Board felt he needed <br /> to reduce his lot coverage to 20% or below since that is the standard they adhere to. <br /> Originally Mr. Atwill's lot coverage with his porch was 23.4% along with his requested <br /> side, front and rearyard variance requests. He has now reduced the lot coverage to <br /> 21.2%, better but not below the 20% mark for a lot of about 6,000 square feet. Mr. <br /> : <br />
