Mashpee Zoning <br /> Board of Appeals Michael and Carol Atwill <br /> 2 V-04-72 <br /> Regan feels Mr. Atwill has accommodated the Board's requests with reasonableness. Mr. <br /> Nelson feels this should further be reduced to get it to 20% or better. After some further <br /> review, Mr. Atwill pulls out another set of plans with a proposal that reduces the lot <br /> coverage even further to 19.9% so as not to necessitate another continuance. The Board <br /> feels he has done his job and Mr. Brem moves to grant the following variances: 13.4 feet <br /> on Sachem Road, .9 feet on the southerly lot line and 25.2 feet on Sakonnet Drive. Mr. <br /> Nelson seconds the motion. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 12 Sachem Road and contains 7,500 <br /> square feet. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. a literal enforcement of the By-laws would involve substantial hardship to <br /> the petitioner. <br /> 2. Desirable relief may be granted without substantial detriment to the public <br /> good and without nullifying or substantially derogating from the intent or <br /> purpose of the by-law. <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded,the Zoning Board of Appeals voted unanimously on June 23, 2004 to <br /> grant: a variance of 13.4 feet on Sachem Road, a variance of.9 feet on the southerly lot <br /> line and a variance of 25.2 feet on Sakonnet Drive. This is conditioned on plans from <br /> Cape &Islands Engineering dated April 6, 2004 and noted to be a lot coverage of 19.9% <br /> on the plans. <br />
