f
Mashpee Zoning
Board of Appeals Ryan Lucas
V-04-81 2
needed and on what street it should be directed to. Mr. Nelson has checked with the
DPW and Mr. Wheeler; applicant has sufficient frontage since he has it on both Lowell
Road and Webquish Lane. Marshall Brem moves to grant a 19' variance on Webquish
Lane, a 19' variance on Lowell Road, a 4 foot variance on the southerly sideyard and a
69,785 square foot landspace variance. Motion is seconded. All agree. So moved.
GENERAL FINDINGS
1. that the subject property is located at 28 Lowell Road and contains 10,215
square feet.
SPECIFIC FINDINGS
The Board determined that:
1. a literal enforcement of the By-laws would involve substantial hardship to
the petitioner.
2. Desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent or
purpose of the by-law.
In view of the foregoing,the Mashpee Zoning Board of Appeals found that the
Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly
made and seconded,the Zoning Board of Appeals voted unanimously on June 23, 2004 to
grant the following:
■ A 19' variance on Webquish Lane;
■ A 19' variance on Lowell Road;
■ A 4' variance on the southerly side yard; and
■ A 69,785 square foot landspace variance.
This variance is conditioned upon plans from Yankee Survey Consultants of Marstons
Mills, MA, dated May 19, 2004, Job # 53674 GM and building plans from Devlin
Custom Designs as revised for 28 Lowell Road, Mashpee.
