Marshall Brem moves to grant a 19' variance on Webquish <br /> Lane, a 19' variance on Lowell Road, a 4 foot variance on the southerly sideyard and a <br /> 69,785 square foot landspace variance. Motion is seconded. All agree. So moved. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 28 Lowell Road and contains 10,215 <br /> square feet. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. a literal enforcement of the By-laws would involve substantial hardship to <br /> the petitioner. <br /> 2. Desirable relief may be granted without substantial detriment to the public <br /> good and without nullifying or substantially derogating from the intent or <br /> purpose of the by-law. <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded,the Zoning Board of Appeals voted unanimously on June 23, 2004 to <br /> grant the following: <br /> ■ A 19' variance on Webquish Lane; <br /> ■ A 19' variance on Lowell Road; <br /> ■ A 4' variance on the southerly side yard; and <br /> ■ A 69,785 square foot landspace variance. <br /> This variance is conditioned upon plans from Yankee Survey Consultants of Marstons <br /> Mills, MA, dated May 19, 2004, Job # 53674 GM and building plans from Devlin <br /> Custom Designs as revised for 28 Lowell Road, Mashpee. <br />
