Mashpee Zoning <br /> Board of Appeals Minutes from Public Hearing on June 23, 2004 <br /> 3 <br /> construction had begun before the ACEC was created, the petitioner would not be here. <br /> He is seeking to build a 3 bedroom house which is minimum considering the size of <br /> thelot. The topography features establish where the ACEC is and that is what the client is <br /> seeking relief from. They would be willing to maintain the 50' buffer from the BV W if <br /> they can obtain relief and build within 25 feet of the ACEC. Mr. Sanicki also informs the <br /> Board that on June 10°i they received approval from Conservation Commission. <br /> Marshall Brem makes a motion to grant the variance as requested. Robert Nelson <br /> seconds the motion. All agree. So moved. <br /> Michael and Carol Atwill: Request a Variance from Section 174-31 of the Zoning By- <br /> laws to vary the setback requirements in order to build a 6' x 10' farmer's porch on <br /> property located in an R-5 zoning district at 12 Sachem Road (Map 65 Parcel 68) <br /> Mashpee, MA. <br /> Sitting: James Regan, Robert Nelson and Marshall Brem. <br /> Mr. Atwill represents himself at this continued hearing. This matter was continued from <br /> the May 26`x' hearing so that the petitioner could have his plans re-drawn for his wrap <br /> around porch that he is requesting a variance for. The Board felt he needed to reduce his <br /> lot coverage to 20% or below since that is the standard they adhere to. Originally Mr. <br /> Atwill's lot coverage with his porch was 23.4% along with his requested side, front and <br /> rearyard variance requests. He has now reduced the lot coverage to 21.2%, better but not <br /> below the 20%mark for a lot of about 6,000 square feet. Mr. Regan feels Mr. Atwill has <br /> accommodated the Board's requests with reasonableness. Mr. Nelson feels this should <br /> further be reduced to get it to 20% or better. After some further review, Mr. Atwill pulls <br /> out another set of plans with a proposal that reduces the lot coverage even further to <br /> 19.9% so as not to necessitate another continuance. The Board feels he has done his job <br /> and Mr. Brem moves to grant the following variances: 13.4 feet on Sachem Road, .9 feet <br /> on the southerly lot line and 25.2 feet on Sakonnet Drive. Mr. Nelson seconds the <br /> motion. All agree. So moved. <br /> Ryan Lucas: Requests a Variance from Section 174-31 of the Zoning By-laws seeking <br /> relief from the frontyard setback requirements and side yard setback requirements in <br /> order to build a new 24' x 36' house with a 14' x 24' garage on property located in an <br /> R-5 zoning district at 28 Lowell Road (Map 52 Parcel 32) Mashpee, MA. Applicant: <br /> Joseph Vaughn <br /> Sitting: Robert Nelson, Richard Guerrera and Marshall Brem. (James Regan stepped <br /> down from this hearing and left the meeting.) <br /> Joseph Vaughn represented the applicant at this hearing. They are seeking a variance in <br /> order to build a new three bedroom house. There is currently a trailer on the property that <br /> applicant will remove in order to accommodate the proposed dwelling. He is seeking <br /> sideyard and frontyard relief and a landspace variance. Mr. Vaughn also informs the <br /> Board that the new driveway will now be on Webquish Lane and will be known as #7 <br /> Webquish Lane. The Board discusses how much of a frontage variance is needed and on <br /> • what street it should be directed to. Mr. Nelson offers to discuss this with the DPW and <br /> Mr. Wheeler as to where this should be done. Marshall Brem moves to grant a 19' <br /> variance on Webquish Lane, a 19' variance on Lowell Road, a 4 foot variance on the <br />
