Notice was given by publication in The Mashpee Enterprise, a
newspaper of general circulation in the Town of Mashpee, on May 21, 2004 and May 28,
2004, a copy of which is attached hereto and made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town Hall on
Wednesday, July 14, 2004, at which time the following members of the Zoning Board of
Appeals were present and acting throughout: James E. Regan I11, Robert G. Nelson and
Marshall A. Brem and Richard Guerrera.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of
Mashpee Zoning By-laws.
Mr. Tom Bunker of BSC Design Group represents the applicants. They are
seeking a 10-foot variance from the front yard setback requirements in order to build a
new 3-bedroom dwelling. Mr. Bunker goes over the plans with the Board and explains
that this is the combination of two lots (that is still in the process of being completed with
the Registry of Deeds). The Conservation Commission has approved the proposal. The
Board would like to see the lot coverage put onto the set of plans provided to the Board.
Mr. Bunker informs the board that the lot coverage will be 12.7% when the two lots are
combined. Marshall Brem moves to grant a 10-foot variance on Spoondrift Circle.
