Mashpee Zoning <br /> Board of Appeals Plymouth Savings Bank <br /> 5 Charles Ha j aar, Trust <br /> Falmouth Road Trust <br /> V-04-95 <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 6 Shellback and contains 39,334 square <br /> feet. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. a literal enforcement of the By-laws would involve substantial hardship to <br /> the petitioner. <br /> 2. Desirable relief may be granted without substantial detriment to the public <br /> good and without nullifying or substantially derogating from the intent or <br /> purpose of the by-law. <br /> 3. Memo from Greg Taylor, DPW, dated September 17, 2004, subsection (b) <br /> the two way street on Shellback Way shall have a center yellow stripe and <br /> signage with graphics not allowing a left hand turn. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded, the Zoning Board of Appeals voted unanimously on September 22, <br /> 2004 to grant a (1) a 25-foot variance for the parking from Falmouth Road to the <br /> paving line; and (2) a 36.5-foot variance from the canopy to the lot line. This <br /> variance is conditioned upon plans from Charles Rowley &Associates, dated June 17, <br /> 2004, revised August 28, 2004, Folio Number F-1877, landscape plans from BSS Design, <br /> Landscape and Architecture,Noah Greenberg Associates, dated April 6, 2004, revised <br /> June 14, 2004,job number 4001. <br />
