Mashpee Zoning <br /> Board of Appeals Minutes <br /> 1 July 14, 2004 <br /> TOWN OF MASHPEE <br /> Zoning Board of Appeals <br /> Minutes - Wednesday, July 14, 2004 <br /> The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, July 14, <br /> 2004 at 7:00 P.M. at the Mashpee Town Hall. Board Members James Regan, and Robert <br /> Nelson were present along with Associate Members Richard Guerrera and Marshall ,. <br /> Brem. Zella Elizenberry and Frederick Borgeson were absent. <br /> The Board is now a 5- person board and must re-organize as such. Marshall Brem makes <br /> a motion to appoint James Regan as the new Chairman. Richard Guerrera seconds the <br /> motion. All agree. So moved. <br /> James Regan makes a motion to appoint Robert Nelson as Vice-Chairman. Richard <br /> Guerrera seconds the motion. All agree. So moved. <br /> Robert Nelson makes a motion to appoint Zella Elizenberry as clerk. James Regan <br /> seconds the motion. All agree. So moved. <br /> The ZBA exists as follows as of July 1, 2004: <br /> James Regan, Chairman <br /> Robert Nelson, Vice-Chairman <br /> Zella Elizenberry, Clerk <br /> Marshall Brem, Board Member <br /> Richard Guerrera, Board Member <br /> Frederick Borgeson, Associate Member <br /> Mr. Nelson reads the continued matters from the agenda. <br /> Martin Ahearn: Requests a Special Permit under Section 174-45-4 of the Zoning By- <br /> laws in order to legalize and existing accessory apartment on property located in an R-5 <br /> zoning district at 33 Winslow Drive (Map 71 Parcel 13 1) Mashpee, MA. <br /> Peter McCormack of Remax Realty represents the petitioner at this hearing. This matter <br /> has been before the board several times and then withdrawn and re-filed for clarity <br /> purposes. Applicant is seeking to legalize the existing accessory apartment in order to <br /> sell the property. He has had this apartment for many years without having the proper <br /> permits. Marshall Brem indicates that he is very unhappy with the way this is being <br /> done. Applicant is able to sell the property for more money with an accessory apartment <br /> and it would not be done in perpetuity since it has to be owner occupied. Mr. Brem <br /> would like to see the new owners come in and apply for the accessory apartment permit. <br />
