Mashpee Zoning <br /> Board of Appeals Charles and Jean Viglas <br /> 2 SP-04-114 <br /> (Demolition Permit) <br /> dwelling, that Mr. Ferragamo is handling. The house was built in 1967 and was built 2 <br /> feet over the property line on abutter's property. This matter must be rectified. There will <br /> be a new septic system and the petitioner has obtained a letter from the abutter allowing <br /> them on their property to rectify the situation. The Board feels this will be an <br /> improvement to the area and sooner or later,the house would need to be moved off the <br /> abutting property owners land. The Board moves to grant petitioners a Special Permit. <br /> GENERAL FINDINGS <br /> 1. that the subject lot is located at 10 Spoondrift Circle and contains .41 acres. <br /> SPECIAL PERMIT CRITERIA <br /> Code of the Town of Mashpee § 174-20 states: "Rebuilding of destroyed or <br /> damaged non-conforming structure. Any non-conforming building or structure destroyed <br /> or damaged by fire, flood lightning, wind or otherwise may be rebuilt, subject to approval <br /> of the Board of Appeals subject to the same conditions as set forth in § 174-24 of this <br /> chapter." <br /> SPECIFIC FINDINGS <br /> Per § 174-24 of the Zoning By-laws,the Board determined that the proposed use <br /> or development: <br /> 1. is consistent with applicable state and town regulations, statutes, bylaws and <br /> plans. <br /> 2. will not adversely affect public health or safety. <br /> 3. will not cause excessive demand on community facilities. <br /> 4. will not significantly decrease surface or groundwater quality or air quality. <br /> 5. will not have a significant adverse impact on wildlife habitat, estuarine <br /> systems, traffic flow, traffic safety, waterways, fisheries, public lands or <br /> neighboring properties. <br /> 6. will not cause excessive levels of noise, vibrations, electrical disturbance, <br /> radioactivity or glare. <br /> `F <br />
