Mashpee Zoning <br /> Board of Appeals Charles and Jean Viglas <br /> 3 SP-04-114 <br /> (Demolition Permit) <br /> 7. will not destroy or disrupt any species listed as rare, endangered or threatened <br /> by the Massachusetts Natural Heritage Program or any known historic or <br /> archaeologic site. <br /> 8. will properly dispose of stumps, construction debris, hazardous materials and <br /> other waste. <br /> 9. will provide adequate off-street parking. <br /> 10. will not cause excessive erosion or cause increased runoff onto neighboring <br /> properties or into any natural river, stream, pond or water body and will not <br /> otherwise be detrimental to the town or the area. <br /> 11. will be an improvement with installation of a new Title V septic system. <br /> 12. the proposed structure will be farther away from the wetlands than the existing <br /> structure. <br /> 13. while the proposed structure will increase the non-conforming nature of the <br /> structure,the changes will not result in a structure or use which is more <br /> detrimental to the neighborhood than the prior non-conforming structure and <br /> its use. <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> applicant met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded,the Zoning Board of Appeals voted unanimously on August 24, <br /> 2004 to grant a Special Permit. The Special Permit is conditioned upon compliance with <br /> the proposed site plan from Cape &Islands Engineering, dated February 3, 2004 and <br /> revised June 25, 2004, and plans from Anthony Ferragamo, dated June 30, 2004 as <br /> prepared for the Viglas House. <br />
