Mashpee Zoning <br /> Board of Appeals Minutes <br /> 1 August 24, 2004 <br /> TOWN OF MASHPEE <br /> Zoning Board of Appeals <br /> Minutes—Tuesday, August 24, 2004 <br /> The Mashpee Zoning Board of Appeals held Public Hearings on Tuesday, August 24, <br /> 2004 at 7:00 P.M. at the Mashpee Town Hall. Board Members James Regan, and Robert <br /> Nelson, Richard Guerrera and Marshall Brent were present. Zella Elizenberry and <br /> Frederick Bergeson were absent. <br /> Mr. Regan brought the meeting to order at 7:00 <br /> Mr. Nelson read the last minute continued matters. <br /> Mr. Nelson made an announcement regarding the article in the Mashpee Enterprise with <br /> respect to the ZBA violating the open meeting law when they entered into Executive <br /> Session and interviewed a potential candidate for an alternate on the board. Mr. Nelson <br /> stated that it he who asked that they enter into Executive Session and not Mr. Regan, as <br /> the newspaper indicated. He felt the candidate should have some privacy when being <br /> interviewed and did not realize this motion would cause a violation of the open meeting <br /> law. He should have adjourned the meeting and asked the subcommittee who does the <br /> interviewing process to remain behind. He apologized for any inconvenience this caused <br /> to Mr. Regan. Mr. Regan thanked Mr. Nelson for his comments. <br /> William and Gail Levine: Request a Special Permit from Section 174-17 of the Zoning <br /> By-laws to alter a pre-existing non-conforming structure on property located in an R-3 <br /> zoning district at 37 Fiddler Crab Lane (Map 105 Parcel 105) Mashpee, MA. <br /> William and Gail Levine: Request a Variance from Sections 174-31 and 174-33 of the <br /> Zoning By-laws to vary the landspace requirements, the frontage requirements, the <br /> setback requirements and the distance to the wetlands in order to build a 9' x 12' <br /> addition, an expansion of a deck by 3.5 feet and a 7.5 shower on property located in an R- <br /> 3 zoning district at 37 Fiddler Crab Lane (Map 105 Parcel 105) Mashpee, MA. <br /> David Sanicki of Cape & Islands Engineering represents the petitioner at this hearing. <br /> They are seeking a special permit to alter a pre-existing non-conforming structure and <br /> several variances in order to build the addition and expansions they would like to <br /> accomplish. The lot is non-conforming and they would like to clean up everything to <br /> have it meet the current zoning requirements. Conservation has approved the request. <br /> Marshall Brem moves to grant the special permit. Robert Nelson seconds the motion. All <br /> agree. So moved.
