Marrshall <br /> Brem seconds the motion. All agree. So moved. <br /> Mr. Regan excuses himself from the rest of the agenda due to a conflict and leaves the <br /> meeting. <br /> Dolores Baker Trust, Sunset Circle Nominee Trust: Request a Special Permit under <br /> Section 174-24 I.9 of the Zoning By-laws in order to license and maintain an existing <br /> pier, ramp and float on property located in an R-5 zoning district at 2 Sunset Circle (Map <br /> 64 Parcel 1) Mashpee, MA. <br /> Sitting: Zella Elizenberry, Marshall Brem, Robert Nelson, Richard Guerrera and <br /> Frederick Bergeson. <br /> This matter is called—however, no one is present for the hearing. Lori Corsi informs the <br /> Board that due to some confusion with a lack of quorum at the previous hearing, it should <br /> be continued to give the applicant one more chance. The matter is continued until <br /> September 22, 2004. All agree. So moved. <br /> Jilian B. Hayes: Requests a Special Permit under Sections 174-17 and 174-20 of the <br /> Zoning By-laws in order to demolish the existing dwelling and alter a pre-existing non- <br /> conforming structure and build a new 5 bedroom dwelling on property located in an R-3 <br /> . zoning district a 5 Compass Circle (Map 105 Parcel 260) Mashpee, MA. <br /> Sitting: Zella Elizenberry, Marshall Brem, Robert Nelson, Richard Guerrera and <br /> Frederick Borgeson. <br /> Michael Grotkze of The Phoenix Group represents the applicant at this hearing. They are <br /> seeking a special permit to alter and demolish a pre-existing non-conforming structure <br /> and replace it with a new 5 bedroom dwelling. This matter was initially advertised for a <br /> variance to install a swimming pool, however, the Conservation Commission had the <br /> applicant relocate the pool and therefore it pushed the dwelling into the zoning setbacks <br /> therefore requiring relief from the front yard setback requirements. The board reviews <br /> the plans with Mr. Grotzke. This will be an improvement to the area with a new septic <br /> system as well. All is acceptable to the Board of Health and Conservation. Marshall <br /> Brem moves to grant the special permit. Richard Guerrera seconds the motion. All <br /> agree. So moved. <br /> Thomas and Evonne Fazio: Request a Variance from Section 174-31 of the Zoning By- <br /> laws to vary the side setback requirements in order to build a 31' x 19' deck on property <br /> located in an R-5 zoning district at 136 James Circle (Map 71 Parcel 1) Mashpee, MA. <br /> Sitting: Zella Elizenberry, Marshall Brem, Robert Nelson, Richard Guerrera and <br /> Frederick Borgeson. <br /> i <br />
