Mashpee Zoning
Board of Appeals Minutes
6 September 8, 2004
Mr. and Mrs. Thomas Fazio represent themselves at this hearing. They are seeking a
variance in order to expand their existing deck. The Board reviews the plans and
question the applicant about the topography of where the deck is going. Marshall Brem
makes a motion to grant an 11.4 foot variance for the deck and a 13.1 foot variance to the
front building corner of the lot. Zella Elizenberry seconds the motion. All agree. So
moved.
Willowbend Country Club, Inc.: Request a Variance from Section 174-31 of the
Zoning By-laws to vary the setback requirements in order to install a swimming pool on
property located in an R-3 zoning district at 29 Shoestring Bay Road (Map 84 Parcel 23)
Mashpee, MA. Applicant: Robert and Syrul Lurie
Sitting: Zella Elizenberry, Marshall Brem, Robert Nelson, Richard Guerrera and
Frederick Borgeson.
Attorney Jack McLinney represents the applicant at this hearing. They are seeking a
variance in order due to the fact that by installing a swimming pool where conservation
has requested them to, it infringes on the front setback requirements for this zoning
district. The new dwelling will need a 5.5 foot frontyard variance. Conservation has
approved this matter. The lot coverage will be 13.5% and is sufficient. Marshall Brem
moves to grant a 5.5 foot variance on the frontyard setback requirements. Zella
Elizenberry seconds the motion. All agree. So moved.
Marshall Brem makes a motion to adjourn the meeting at 9:15 p.m. Richard Guerrerra
seconds the motion. All agree. So adjourned.
