Mashpee Zoning <br /> Board of Appeals Minutes <br /> 1 October 13, 2004 <br /> TOWN OF MASHPEE <br /> Zoning Board of Appeals <br /> Minutes - Wednesday, October 13, 2004 <br /> The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, October 13, <br /> 2004 at 7:00 P.M. at the Mashpee Town Hall. Board Members James Regan, Robert <br /> Nelson and Zella Elizenberry were present along with Associate Member Frederick <br /> Borgeson. Marshall Brem and Richard Guerrera were absent. <br /> Mr. Regan brought the meeting to order at 7:00 p.m. Mr. Nelson read the continuances <br /> for various reasons. <br /> NEW PUBLIC HEARINGS <br /> Rev. Indenture of Trust of Fried Freida D. Ramaswamy, Trustee: Requests a <br /> Special Permit under Section 174-17 of the Zoning By-laws in order to alter a pre- <br /> existing non-conforming structure to build an addition on property located in an R-3 <br /> zoning district at 18 Cross Tree Way (Map 112 Parcel 22) Mashpee, MA. <br /> Sitting: James Regan, Robert Nelson, Zella Elizenberry and Frederick Borgeson. <br /> Michael Grotzke of the Phoenix Group represented the petitioner along with Architect <br /> Tom O'Neil. They are seeking a special permit in order to alter a pre-existing non- <br /> conforming structure. The Board reviews the site plan and the architectural plans. Mr. <br /> O'Neil explains to the Board that he has designed the new structure to fit in with the <br /> neighborhood. The New Seabury Architectural Review Committee feels this will be a <br /> big improvement to the neighborhood. Mr. Nelson and Mr. Regan discuss the fact that <br /> the proposed dwelling will not meet the current setback requirements. Mr. Grotzke told <br /> the Board that in discussing this project with Russ Wheeler, the former building <br /> inspector, it was decided that they would pursue this with only a special permit and not a <br /> variance since this exists as a non-conforming structure. The existing lot coverage is <br /> 22% and the proposed lot coverage is 26%. Since this matter is grand fathered, the Board <br /> is not overly concerned with the lot coverage since it is a relatively small lot and the <br /> surrounding houses are similar in coverage. The Board feels this will be an improvement <br /> to the area. Zella Elizenberry moves to grant the Special Permit. Frederick Borgeson <br /> seconds the motion. All agree. So moved. Reference site plans from The Phoenix Group, <br /> dated August 20. 2004, revised September 6, 2004 and revised September 16, 2004 as <br /> prepared for 18 Crosstree Way. <br />
