Mashpee Zoning <br /> Board of Appeals Minutes <br /> 2 October 13, 2004 <br /> Karen Jackson: Requests a Special Permit from Section 174-45.4 of the Zoning By- <br /> laws in order to build an accessory apartment on property located in an R-5 zoning <br /> • district at 123 Pimlico Pond Road (Map 2 Parcel 13 1) Mashpee, MA. <br /> Sitting: James Regan, Robert Nelson, Zella Elizenberry and Frederick Borgeson. <br /> Karen Jackson represents herself at this hearing. She is seeking a Special Permit to allow <br /> an accessory apartment above a detached garage that will be quite a distance from the <br /> main dwelling. The new by-laws do not require the structures to be attached which the <br /> /board questions. She is planning to have a separate septic system installed just for this <br /> apartment since the distance is too far from the main house. The Board reminds Ms. <br /> Jackson that the main dwelling must be owner occupied even though it is detached. Mr. <br /> Regan does not want this to be condominium zed or sub-divided at any point. The Board <br /> feels this is reasonable and will consider it a 3-bedroom dwelling with a one-bedroom <br /> apartment. Abutters Tom and Sandra Mackey submit a letter in support of the project. <br /> Mr. Nelson moves to grant the Special Permit. Zella Elizenberry seconds the motion. <br /> All agree. So moved. Lane: Requests a Special Permit from Sections 174-17 and 174-20 of the <br /> Zoning By-laws to alter a pre-existing non-conforming structure and demolish a portion <br /> of the structure on property located in an R-3 zoning district at 30 Wilson Grove (Map <br /> 118 Parcel 81) Mashpee, MA. <br /> Kenneth G. Lane: Requests a Variance from Section 174-31 of the Zoning By-laws to <br /> vary the setback requirements in order to replace and rebuild portions of said dwelling on <br /> property located in an R-3 zoning district at 30 Wilson Grove (Map 118 Parcel 81) <br /> Mashpee, MA. <br /> Sitting: James Regan, Robert Nelson, Zella Elizenberry and Frederick Borgeson. <br /> Kenneth Lane and Terry Luff, Architect represent themselves at this hearing. They are <br /> seeking a special permit to alter and demolish a pre-existing non-conforming structure <br /> and a variance for relief to the setback requirements. Mr. Lane informs the Board that the <br /> area in Wilson Grove are all about 5,000 square foot lots and pre-date the zoning. They <br /> plan to remain in the same footprint; however, the existing footprint does not meet the <br /> current zoning requirements. The Board discusses that area in general and how the lots <br /> are so small. The existing septic system is about 10 years old and can accommodate the <br />
