Mashpee Zoning <br /> Board of Appeals Minutes <br /> 3 October 13, 2004 <br /> alterations. The Board of Health has limited the dwelling to 2 bedrooms and all other <br /> rooms must have a six-foot opening. They plan to keep the foundation and go up for the <br /> • second floor.expansion. The Board feels the variance is not necessary since the existing <br /> dwelling is pre-existing and would necessitate too many variances and recommend that <br /> Mr. Lane withdraw his variance request. Mr. Lane asks the Board to withdraw his <br /> variance and the Board makes a motion to do so. They all agree. So moved. A motion is <br /> made by Frederick Bergeson to grant the special permit request. Zella Elizenberry <br /> seconds the motion. All agree. So moved. Reference site plans from Carmen Shay of <br /> East Falmouth, MA, dated September 17, 2004, File Name Lane, DWG, and plans from <br /> Terry Luff, Architect of Mashpee, MA, dated March 26, 2004. <br /> Gary and Jane Gomes: Requests a Variance from Section 174-31 of the Zoning By- <br /> laws in order to vary the setback requirements to install a swimming pool on property <br /> located in an R-3 zoning district at 62 Regatta Drive (Map 52 Parcel 137) Mashpee, MA. <br /> Owner of Record: Brian T. Dacey, Trustee Sconset Village Nominee Trust <br /> Sitting: James Regan, Robert Nelson, Zella Elizenberry and Frederick Borgeson. <br /> John Bosse and applicant Gary Gomes represent at the hearing. The applicant is seeking <br /> a variance in order to install a swimming pool for his severe arthritic condition and he <br /> cannot meet the current setback requirements by installing the pool in the only available <br /> place. This is a cluster subdivision and there is open space in the rear of the lot. <br /> Owner/builder of the subdivision owns lot 419 and as yet, it is not sold. Mr. Gomes <br /> submits a letter from the Director of the Cape Cod Rehabilitation Center, Joseph P. <br /> • Carroll stating that water therapy has been helpful to his patient for his severe arthritic <br /> condition. The Board feels this is a reasonable request and Frederick Borgeson moves to <br /> grant an 8.6-foot variance on the side and a 14-foot variance in the rear. Robert Nelson <br /> seconds the motion. Mr. Borgeson would like to have any future purchasers of lot #19 <br /> made aware of this situation before the lot is sold. Mr. Bosse said that is not a problem. <br /> All agree. So moved. Reference plans from Christopher Costa'& Associates, Inc., dated <br /> March 17, 2004 and revised June 18, 2004. <br /> Lance Lambros: Requests a Special Permit from Section 174-25 G (11) of the Zoning <br /> By-laws to add the use of screen printing and embroidery with light manufacturing on <br /> property located in an 1-1 zoning district at 56 Nicoletta's Way (Map 26 Parcel 21) <br /> Mashpee, MA. Owner of Record: Stephen Giatrelis <br /> Sitting: James Regan, Robert Nelson, Frederick Borgeson and Zella Elizenberry. <br /> Lance Lambros represents himself at this hearing. He is seeking a special permit to allow <br /> for a specific use for his company that is going into Nicoletta's Way. His company has <br /> been at the Cheapo Depot spot and he is going to move his business into the new area on <br /> Nicoletta's Way. It is a tee shirt printing and screening company with 2 bays that will <br /> contain 3300 square feet. He has been in business for 13 years and in Mashpee for 6 <br /> years.
