Mashpee Zoning <br /> Board of Appeals Minutes <br /> 4 October 13, 2004 <br /> incorporated several requirements for compliance with the permit if the Board approves <br /> the permit and they are as follows: <br /> • ✓ A change of occupancy must have Board of Health approval <br /> ✓ Hazardous materials shall be limited to 200 pounds of dry weight and 220 gallons <br /> of liquid storage <br /> ✓ Storage of hazardous waste or materials outside is prohibited <br /> ✓ Floor drains are prohibited <br /> ✓ Painting and or use of solvents/lacquers shall be limited to a paint booth with <br /> vented discharge and/or in accordance with the Mass. Air Quality Regulations <br /> ✓ Stormwater generated from impervious surfaces shall be collected and treated <br /> ✓ Proposed sanding operations shall be performed with dustless sanders <br /> ✓ Proposed maintenance of vehicles and/or water vessels shall be performed in an <br /> indoor or semi-enclosed area on maintenance pads <br /> ✓ Maintenance contracts shall be submitted to the Board of Health prior to a <br /> certificate of occupancy <br /> ✓ Proposed pressure washing shall be treated as industrial wastewater. <br /> The Board feels this is a reasonable request and fits in well with the other business in the <br /> area. Robert Nelson moves to grant the special permit. Zella Elizenberry seconds the <br /> motion. All Agree. So moved. <br /> Brian Marc Kantor: Requests a Special Permit from Section 174-20 of the Zoning By- <br /> laws in order to demolish existing structure and build a new dwelling on property located <br /> in an R-3 zoning district at 36 and 40 Great River Road (Map 120 Parcels 69 and 70) <br /> Mashpee, MA. <br /> Brian Marc Kantor: Requests a Variance from Section 174-31 of the Zoning By-laws <br /> to vary the setback requirements in order to build a new dwelling on property located in <br /> an R-3 zoning district at 36 and 40 Great River Road (Map 120 Parcels 69 and 70) <br /> Mashpee, MA. <br /> Brian Kantor represents himself at this hearing. He is seeking a special permit to <br /> demolish the existing dwelling and a variance for setback relief. He presents plans to the <br /> Board as well as pictures of area houses that have accomplished the same request he is <br /> setting out to do. This would be an improvement to the area for what exists on the two <br /> lots now. The shed would be torn down building this new dwelling would eliminate the <br /> encroachment that currently exists on the adjoining lot. This area in Monomoscoy Island <br /> predates zoning. An abutter, Ted O' Rourke of 37 Great River Road fully supports the <br /> permitting application. The lot coverage being proposed is 14% and a very technical new <br /> septic system is going to be installed since it is on the water. Conservation has approved <br /> the request as well as the Board of Health for a 3 bedroom dwelling with DEP <br /> concurrence. Frederick Borgeson moves to grant the following: <br /> ✓ A 13 foot variance to the wetlands <br /> ✓ A 10 foot variance on the northerly sideline <br />
