Forte, Jr. 101 Popponesset Island Road <br /> Map 112 Block 30 <br /> V-04-167 <br /> A Petition was filed on November 4, 2004 by Robert M. Forte, Jr. for a Variance <br /> from Section 174-31 of the Zoning By-laws for permission to vary the setback <br /> requirements to allow for construction of an addition, new deck and stairs and to change <br /> the pitch in the roof to prevent further leaking on property located in an R-3 zoning <br /> district at 101 Popponesset Island Road (Map 112 Block 30) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on November 19, 2004 and <br /> November 26, 2004 a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, December 8, 2004, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James E. Regan 111, Zella E. <br /> Elizenberry, Robert Nelson, Marshall Brem and Richard Guerrera. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Engineer Richard Ferreria of East Falmouth represents petitioner. They are <br /> seeking several variances in order to do some renovations to the house. A problems <br /> exists with the dwelling as the dwelling currently extends 8/1 Ot" of a foot beyond the <br /> property line. Attached is the deed for encroachment and maintenance of easement. <br /> Petitioner is seeking to build an addition, remove existing stairs and deck and replace <br /> both with new. The Board reviews the plans and finds this to be an unusual situation <br /> whereby a portion of petitioner's dwelling extends beyond their property line. Petitioner <br />
