Mashpee Zoning 2 <br /> Board of Appeals Robert M. Forte, Jr. <br /> V-04-167 <br /> is also seeking to raise the roof pitch to prevent further leaking. The Board feels this is <br /> reasonable and moves to grant the variances. <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 101 Poppponesset Island Road and <br /> contains 19,334 square feet. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded, the Zoning Board of Appeals voted unanimously on December 8, <br /> 2004 to grant the following variances: <br /> ✓ 7.5 foot variance on the front yard setback <br /> ✓ 10 foot variance on the southerly lot line <br /> ✓ 6.7 foot variance on the north side <br /> ✓ Note: the north rear corner of the existing building extends in the <br /> easement by 8/10"' of a foot. <br /> The Variance is conditioned upon compliance with plans from Ferreira Associates of <br /> Falmouth, MA, dated August 24, 2004, revised October 7, 2004 No. 117. <br />
