The Owner of Lot <br /> 267 acquired title to the property by deed recorded with the <br /> Barnstable County Registry District of the Land Court on May 26, <br /> 1994 <br /> WHEREAS, a dispute has arisen between the Owners -of Lots 266 <br /> and the Owner of Lot 267 that these parties now desire and intend <br /> to resolve. <br /> NOW THEREFORE, in consideration of and pursuant to the terms <br /> of a Settlement Agreement, executed by the above noted parties of <br /> even date, and the mutual covenants, agreements, conditions and <br /> provisions, set forth therein and herein, the said parties do <br /> hereby agree as follows: <br /> 1. Voluntary -Abandonment of Access Easement. That certain <br /> access easement reserved for the Owners of Lot 266 in that <br /> certain deed from Robert C. Persons and Dorothea M. Persons to N. <br /> Paul Piccirillo dated December 17, 1986 and recorded with the <br /> Barnstable County Registry District of the Land Court as Document <br /> No. 414595, Certificate of Title No. 10921 (which is hereinafter <br /> referred to as the "Access Easement") and which encumbers Lot 267 <br /> for the benefit of the Owners of Lot 266, is hereby voluntarily <br /> abandoned and terminated for 'all purposes. <br /> 2 . New Access Easement. In consideration of the above said <br /> voluntary abandonment and termination of the Access Easement, the <br /> Owner of Lot 267 does hereby grant to the Owners of Lot 266 <br /> (their heirs, successors, assigns, invitees and guests) the <br /> perpetual easement to cross and re-cross over Lot 267 as shown on <br /> -2- <br />
