and in accordance with that certain easement layout entitled <br /> "Proposed Easement" and "Proposed Easement Detail,' shown on a <br /> plan of land entitled "Plot Plan of Land located in Mashpee - <br /> Mass. " prepared for Robert Forte dated May 6, 1996 by Ferreira <br /> Associates (hereinafter referred to as the "Ferreira Plan") , for <br /> the purpose of providing both pedestrian and vehicle access to <br /> and from the rear of the dwelling currently situated on Lot 266, <br /> however the Owner of Lot 267 does not guarantee that any vehicle <br /> access will be ultimately permitted by state or local <br /> authorities. The Ferreira Plan shall be recorded herewith and <br /> filed with the land registration office at Boston (and copies <br /> filed or reference made in the Barnstable County Registry of <br /> Deeds with the Owner of Lots 266 and 267 Certificates of Title) . <br /> 3 . Encroachment Easement. As further consideration of the <br /> above said voluntary abandonment of Access Easement, the Owner of <br /> Lot 267 does hereby grant to the Owners of Lot 266 (their heirs <br /> and successors in title) a perpetual easement for the <br /> encroachment of the existing house and deck on Lot 267 <br /> (hereinafter referred to as the "House Encroachment") also as <br /> shown on the Ferreira Plan.
