Town of Mashpee <br />A 16 Great ss ck woad worth <br />MASHPEE ZONING BOARD OF APPE <br />shpee,l�'laachusetts 02649 <br />RE: Edmond Clermont <br />DECISION FOR A VARIANCE <br />One Sunset Circle <br />Map 64 Parcel 36 <br />V-03-01 <br />A Petition was filed on November 27, 2002 by Edmond Clermont for a Variance <br />from Sections 174-31, 174-21 and 174-33 of the Zoning By-laws for permission to vary <br />the side setbacks, lot coverage requirements, the setback requirements to water and <br />wetlands, frontage requirements and lot size requirements in order to demolish the <br />existing house and build a new house on a pre-existing, non -conforming structure on <br />property located in an R-5 zoning district at One Sunset Circle (Map 64 Parcel 36) <br />Mashpee, MA. <br />• Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br />a newspaper of general circulation in the Town of Mashpee, on December 27, 2002 and <br />January 3, 2003, a copy of which is attached hereto and made a part hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, January 8, 2003 and continued to January 22, 3003 at which time the <br />following members of the Zoning Board of Appeals were present and acting throughout: <br />James Regan, III, Robert Nelson and Zella Elizenberry. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br />Mashpee Zoning By-laws. <br />Attorney Kevin Kirrane and David Sanicki of Cape & Islands Engineering <br />represented the petitioner. Mr. Kirrane informs the Board that petitioner has worked <br />
