191 <br />Town of Mashpee <br />IVIASHFEE ZONING BOARD OF APPEALS 16 Great Veck load Xorth <br />Paul Hanlon <br />Decision for a Variance Mashpee, Massachusetts 02649 <br />51 Popponesset Island Road <br />Map 106 Parcel 13 <br />V-03-27 <br />A Petition was filed on January 31, 2003 by Paul Hanlon of Walpole for a <br />Variance from Section 174-31 of the Zoning By-laws for permission to vary the lot <br />coverage and the sideline setback requirements to allow for the installation of a 32' x 15' <br />in -ground swimming pool on property located in an R-3 zoning district at 51 Popponesset <br />Island Road (Map 106 Parcel 13) Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br />newspaper of general circulation in the Town of Mashpee, on February 14 and February <br />21, 2003, a copy of which is attached hereto and made a part hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, February 26, 2003, at which time the following members of the Zoning <br />Board of Appeals were present and acting throughout: Marshall Brem, Zella Elizenberry <br />and Richard Guerrera. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br />Mashpee Zoning By-laws. <br />Mr. David Sanicki of Cape & Islands Engineering represented the applicant. He <br />is seeking an increase in lot coverage by 2.7% and a 4 -foot Variance on the rear setbacks <br />in order to install a swimming pool. Mr. Hanlon states his neighbors have no problems <br />with this and the septic system is not affected. The Board moves to grant this Variance. <br />No comments from abutters. <br />GENERAL FINDINGS <br />1. that the subject property is located at 51 Popponesset Island Road and <br />0 <br />contains 15,279 square feet. <br />
