Mashpee Zoning Paul Hanlon <br />Board of Appeals V-03-27 <br />2 <br />• VARIANCE CRITERIA <br />Section 10 of Chapter 40A requires that the permit granting authority determine <br />that there are circumstances relating to the shape and topography which affect this lot and <br />not the district in which it is located and that a literal enforcement of the By-laws would <br />involve hardship to the petitioner. <br />SPECIFIC FINDINGS <br />1. that a literal enforcement of the By-laws would involve hardship to the <br />Petitioner. <br />2. that relief may be granted without detriment to the public good. <br />3. that relief may be granted without derogating from the intent or purpose of the <br />By-laws. <br />In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br />applicant met the criteria necessary for the granting of a Variance. Upon motion duly <br />made and seconded, the Zoning Board of Appeals voted unanimously on February 26, <br />2003 to grant a 4 -foot Variance on the rear setbacks and a 2.7% increase in lot coverage <br />conditioned on plans from Cape & Islands Engineering, Plan No. 120401, File No. <br />109MA, Septic File No. 70, dated December 4, 2001, revised December 11, 2001, <br />revised, December 14, 2001, revised January 8, 2002, revised March 29, 2002, revised <br />April 24, 2002, revised May 6, 2002, revised January 30, 2003. These Variances are also <br />conditioned on landscaping plans from Mary LeBlanc dated July 23, 2002 for the Hanlon <br />Residence. All agree. So moved. <br />
