0 <br />Town of Mashpee <br />F APPEALS 16 Great JVeck Pvoad Vorth <br />Decision for a Special Permit <br />RE: Michael Sliwa <br />Mashpee, Massachusetts 02649 <br />94 Redbrook Road <br />Map 110 Parcel 63 <br />SP -03-29 <br />A Petition was filed on January 31, 2003 by Michael Sliwa to request a Special <br />Permit under Section 174-17 of the Zoning By-laws to expand a pre-existing non- <br />conforming structure with an addition to the existing dwelling. This property is located <br />in an R-3 zoning district at 94 Redbrook Road (Map 110 Parcel 63) Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br />newspaper of general circulation in the Town of Mashpee, on February 14, and February <br />21, 2003 a copy of which is attached hereto and made a part hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, February 26, 2003, at which time the following members of the Zoning <br />Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry <br />and Richard Guerrera. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br />Mashpee Zoning By-laws. <br />Mr. David Sanicki of Cape & Islands Engineering represented the petitioner. He <br />is seeking a Special Permit due to the fact that the current dwelling he is seeking to <br />expand is a pre-existing non -conforming structure and was built in 1945 which pre -dates <br />zoning. A new septic system will be installed which will be an asset to the property. The <br />Board moves to grant the Special Permit. <br />
