Mashpee Zoning <br />Board of Appeals Michael Sliwa <br />2 SP -03-29 <br />• GENERAL FINDINGS <br />1. that the subject property is located at 94 Redbrook Road and contains 24,513 <br />square feet. <br />SPECIAL PERMIT CRITERIA <br />Section 174-17 of the Mashpee Zoning By-laws and Massachusetts General <br />Laws Chapter 40A, Chapter 6, require a finding that the extension, alteration or change <br />shall not be substantially more detrimental to the neighborhood than the existing <br />non -conforming use. <br />SPECIFIC FINDINGS <br />Per § 174-24 of the Zoning By-laws, the Board determined that the proposed use or <br />development the Board determined that: <br />1. the changes between the proposed addition and the prior one will result in an <br />• increase in lot coverage but it is under the allowed 20%. <br />2. while the proposed construction will increase the non -conforming nature of <br />the structure, the changes will not result in a structure or use which is more <br />detrimental to the neighborhood than the prior non -conforming structure and <br />its use. <br />3. the immediate neighborhood consists of single-family homes of similar size. <br />Many have been improved with additions or reconstruction. <br />4. will not adversely affect public health or safety. <br />5. will not cause excessive demand on community facilities. <br />6. will not significantly decrease surface or groundwater quality or air quality. <br />7. will not have a significant adverse impact on wildlife habitat, estuarine <br />systems, traffic flow, traffic safety, waterways, fisheries, public lands or <br />neighboring properties. <br />8. will not produce amounts of trash, refuse or debris in excess of the town's <br />landfill and waste disposal capacities. <br />
