M <br />Town of Mashpee <br />MASHPEE ZONING BOARD OF APPEALS 16 Great JVeck Poad Vorth <br />Mashpee, Massachusetts 02649 <br />Decision for a Special Permit <br />John Belland 44 Barbary Circle <br />Map 96 Parcel 104 G <br />SP -03-41 <br />A Petition was filed on February 25, 2003 by John Belland for a Special Permit <br />under Section 174-25.I.9 of the Zoning By-laws to allow for construction of a pier, ramp <br />and float on Mashpee River on property located in an R-3 zoning district at 44 Barbary <br />Circle (Map 96 Parcel 104 G) Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br />a newspaper of general circulation in the Town of Mashpee, on March 14, and March 21, <br />2003, a copy of which is attached hereto and made a part hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, March 26, 2003, at which time the following members of the Zoning Board <br />of Appeals were present and acting throughout: James E. Regan III, Robert G. Nelson <br />and Marshall Brem. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br />Mashpee Zoning By-laws. <br />Mr. John Vaccara of Falmouth Engineering represented the petitioner. He is <br />seeking to replace 28 feet of his existing floating dock to a fixed pier. The dock is <br />showing wear and needs to be replaced. This will entail adding 4 new piles into the <br />Mashpee River. Conservation Commission and the Harbormaster have approved this <br />project. The Board moves to grant the Special Permit. <br />• <br />
