�r <br /> Mashpee Zoning <br /> Board ofAppeals Minutes June 11,2003 <br /> 1 <br /> TOWN OF MASHP B <br /> Zoning Board of Appeals <br /> Minutes - Wednesday, June 11, 2003 <br /> The Mashpee Zoning Board of Appeals held Public Hearings Wednesday, June 11, <br /> 2003 at 7:00 P.M. at the 1lashpcc Town Hall. Board Members: Chairman Edward <br /> Govoni, vice Chairman Janes Regan,n, and Clerk Robert Nelson were presents along with <br /> Associate Members er Marshall Brem, (arrived at 7:25 p.m.) and Richard Gu rrcra were in <br /> attendance. <br /> Mr. G v ni brought the meeting to order at 7:00 p.m. <br /> Bay Point Realty Trust: Requests a Special Permit under Section 174-25-H-7 of the <br /> Zoning By-laws in order to build an accessory structure (private garage) on property that <br /> cannot he developed as a principle residential use located in an R-3 zoning district at One <br /> Point Road Map 114 Parcel 3 1 lashpe , 1 A. <br /> Sitting: Due Mr. Brem's ahesence at this point in the meeting, the Rule of Necessity put <br /> Richard Guerrera and James began on this hearing. <br /> Mr. John Slavinsl y of Cape & Islands Engineering along with Eric B away were present <br /> for the hearing. This natter has been continued on three different occasions for the <br /> Board's consideration as well as more research from Mr. Benway regarding free standing <br /> garages in the area. They once again ask for the Special Permit in order to build the <br /> garage. Mr. Nelson discusses the fact that the piece of land is not really worth anything <br /> to the Town with respect to large tax revenue since it is an uninhabitable lot and would <br /> really improve the arca. After much discussion and several continued hearings, the <br /> Board moves to grant the Special Permit with conditions. The motion is seconded. All <br /> agree. So moved. <br /> Mr. Benway must combine both lots 11 Bay Road (where his home is) and One Point <br /> into one deed so that one must be sold with the other. <br /> The garage must he no more than 15 feet in height. <br /> Deference plans from Cape & Islands Engineering, dated Jure 12, 2002, and most <br /> recently revised April 15, 2003, File 1 . 111 MA 12CC as prepared for Eric <br /> Benay/Bay Point Realty Trust. <br /> AnthonyShuman and Dorothy Kagan: Request a variance from Sections 174-21, 174- <br /> 31 and 174-32 of the Zoning By-laws in order to vary the land space requirements, <br /> acquire road access and have this deemed a separate and buildable lot on property located <br /> in an R-5 oni . district at 29 Pickerel Cove Circle Map 14 Parcel Mashpe , IIA. <br />
