F <br /> .7 <br /> Mashpee Zoning <br /> Board of Appeals Minutes Jure 11,2003 <br /> Anthony Shuman and Dorothl._K, n: Request a variance from Sections 174-21, 174- <br /> 31 <br /> 7 - <br /> 31 and 174-32 of the Zoning By-laves in order to vary the land space requirements, <br /> acquire road access and have this deemed a separate and buildable lot on property located <br /> in an R-5 zoning district at 25 Pickerel Cove Circle Map 14 Parcel i rlashpee, MA. <br /> Sitting: Due to Mr. rem's absence at this point, the Rule ofNecessity will put Edward <br /> Gvni on this hearing. <br /> This matter was continued from May 28, 2003 and Jahn Slavins y again represents the <br /> petitioners. The Board asked for a continuance at the last hearing so that the Fire <br /> Department could visit the site and comment. Deputy Sheldon Hamblin provided a <br /> memo which will be attached to the decision with its requests. Once again, in opposition <br /> to this matter is Arthur Breyer ofPickerel Cove. He again states that he is opposed t <br /> two hones going up there and that in his opinion, the Board has no right to grant a <br /> variance on two lots that are 1n contiguous ownership. Mr. G v ni and Mr. Breyer <br /> discuss this in detail. Thomas Choate of Pickerel Cove is also present again and reiterates <br /> his displeasure with two lot being granted as buildable. He indicates that he maintains <br /> the gravel road in the winter time with plowing and the lite and feels that an extra house <br /> would provide too many vehicles going down that street. There is a heated debate <br /> between the parties in opposition and the petitioners. Mr. Govoni calls the meeting t <br /> order after they have heard enough testimony. Mr. Slavinsl y introduces plans with <br /> envelopes on the lots shoving a proposed area for a house on the lot. Susan Kagan <br /> Lang, daughter of the petitioner states her feelings about the responsibility of the road <br /> and that her family has done that. Mr. Choate says they do not. After much consideration <br /> and discussion, the Board moves to grant.the Variance on the lots with several conditions. <br /> The notion is seconded. All agree. So moved. <br /> The variance is granted with the following conditions: <br /> all instructions and requests from the Fire Department must be adhered to and <br /> executed. Fetter will be attached to Decision. <br /> they follow the plans that show the envelopes on the lots along with all other plans <br /> submitted by Cape & Islands Engineering. <br /> Variances for Lot 18 A consist o f 110 feet for the frontage and 3 0,200 square feet for <br /> the land space requirement <br /> Variances for Lot 17A consist of 25 feet for the frontage and 40,060 square feet for <br /> the lana space requirements. <br /> Scott Goldstein: Requests a variance from Section 174-31 ofthe Zoning By-laws t <br /> vary the setback requirements in order to plane a shed on property located in an R-3 <br /> zoning district at 3+7 Amos Landing Road (Map 82 Parcel 2 M shp e, AVIA. <br /> Sitting: Edward Gvni, Robert Nelson and James Regan. <br /> Dorene Goldstein represents her husband the petitioner. She is requesting a 15 foot <br /> variance on her rear lot line in order to put up a shed. They have just recently installed a <br /> built in pool and the shape ofthe lot provides a problem in order to install a shed in their <br />
