Mashpee Zoning <br /> Board of Appeals Minutes June 11,2003 <br /> yard. Auer some discussion with the Board and Russ Wheeler, Building Inspector, the <br /> law is minimally 3 feet off the lot line for a shed. The Board also requests they obtain a <br /> letter from New Seabury authorizing this shed. The Board moves to grant a 12 foot <br /> Variance in the gear. Motion is seconded. All agree. So moved. <br /> Paul Felly: Requests a variance under Section 174-31 of the Zoning -laws to vary <br /> the setback requirements and land space requirements in order to build a detached 2 ' X <br /> 2 ' garage on property located in an R-5 zoning district at 70 Shorewood Drive (Map 58 <br /> Parcel Mashpee, MA. <br /> Sitting: James Regan, Marshall Brenn and Robert Nelson. <br /> Paul Kelly represented himself at this hearing. He is seeking a Variance to build a 24' <br /> " detached garage. There are several abutters that have a problem with the mess in his <br /> yard, ie cars and junk. Robert Robichaud doesn't life all of the parted ears in the yard. <br /> Janet Hubbard is opposed to the garage and the mess in the yard. There is also a <br /> discussion of the use ofhis business on the premises. Mr. Kelly states that nothing <br /> related to his business is ever delivered to his hone and he doesn't do anything that <br /> others on the street and neighborhood do as well. After some discussion ofcleaning up <br /> his yard and cars with the board, they move to grant a 14.9 foot variance on the <br /> southeasterly side and a 19.9 foot variance in the front. The Board also imposes a 25 foot <br /> height maximum for the garage. Reference plans from Norman Grossman of East <br /> Falmouth, MA, no. C-72.8, dated April 3, 2003. The motion is seconded. All agree. So <br /> moved. <br /> Jared West: Requests a Special Pennit from Section 174-2 .A.8 of the Zoning By-laws <br /> to construct an accessory structure in-law apartment) on property located in an R-5 <br /> zoning district at 15 Black Watch Way (Map 16 Parcel 9) Mashpee, MA. <br /> Sitting: James Regan, Robert Nelson and Edward Govoni. <br /> Jared West represents himself at this hearing. He is before the board again to seely <br /> Special Permit for his in-lav apartment. The Board denied him a special permit <br /> previously because Mr. Brem felt he himself misinterpreted the lav on this matter. <br /> Again, John Casey, an abutter opposes this natter if it is used as a rental outside of a <br /> family member. He asks the board how they enforce this matter—obviously the Board <br /> cannot make site visits to see who is living there. There has been a draft of new language <br /> for what constitutes ars "in-law"' apartment. The use of the word in-law will have to go <br /> by the wayside and"accessory structure' must be used instead, Linda Casey an abutter as <br /> well as Irving Lewis, of 7 Cutlass Lane, would like an explanation of the specifics of the <br /> by-laws. Mr. Regan informs them that if they are this passionate about the special permit <br /> by-laves they need to get themselves on the warrant and try to change things through the <br /> Ton Meeting. The Board can only work with the by-laves they have before them at <br /> present. The Board moves to grant the Special Permit to Ir. West. The motion is <br /> seconded. All agree, So moved. <br />
