Mashpee Zoning
Board of Appeals Minutes
4 July 9,2003
Thomas Quinn: Requests a Variance under Section 174-31 of the Zoning By-laws
seeking relief from contiguous lot ownership to have this lot deemed buildable on
property located in an R-5 zoning district at 173 Main Street (Map 37 Parcel 50)
Mashpee, MA. Owner of Record: Joseph V. Maruca, Trustee of the Bologna Realty
Trust.
Sitting: James Regan, Robert Nelson and Zella Elizbenberry.
Mr. Quinn represents himself at this hearing. He is seeking relief from contiguous lot
ownership and several variances in order to have this lot deemed buildable. The lot is
located across from Jonas Drive on Cowit Road. Mr. Quinn describes the chain of deeds
and ownership of the lot, which he has submitted for the record. The lot has been
assessed and taxed as a separate and buildable lot. He is proposing a 2-bedroom house to
be put in the back end of the lot. It is determined that Mr. Quinn will need:
- a 57,380 square foot lot size variance
- a 5.3 foot variance on each side
- an 80 foot variance for frontage requirements
Mr. Nelson moves to grant the above variances to Mr. Quinn. Zella Elizenberry seconds
the motion. All agree. So moved.
Emil R. and Alice J. Smith: Request a Variance from Section 174-31 of the Zoning By-
laws to vary the front yard setback requirements and the side yard setback requirements
in order to build a 7' x 13'6 addition on property located in an R-3 zoning district at 2
Pembroke Drive (Map 123 Parcel 73) Mashpee, MA.
Sitting: James Regan, Robert Nelson and Zella Elizenberry.
David Sanicki of Cape & Islands represents the petitioners. They are seeking variance
relief in order to build a new entryway and replace the existing deck with an addition.
Mr. Sanicki goes over the plans with the Board and discuss the requested variances. The
proposed lot coverage will be 13.4%. Mr. Nelson moves to grant the following:
- 5 foot variance on the side
- 3 foot variance on the westerly side
Ms. Elizenberry seconds the motion. All agree. So moved. Mr. Regan adds the
topography of the lot and the fact that it is a corner lot in the Popponessett Overlay
district is a factor in the granting of the variances. Reference criteria 1, 2 and 3 along
with the plans from Cape & Islands.
