Mashpee Zoning <br /> Board of Appeals Minutes <br /> 4 July 9,2003 <br /> Thomas Quinn: Requests a Variance under Section 174-31 of the Zoning By-laws <br /> seeking relief from contiguous lot ownership to have this lot deemed buildable on <br /> property located in an R-5 zoning district at 173 Main Street (Map 37 Parcel 50) <br /> Mashpee, MA. Owner of Record: Joseph V. Maruca, Trustee of the Bologna Realty <br /> Trust. <br /> Sitting: James Regan, Robert Nelson and Zella Elizbenberry. <br /> Mr. Quinn represents himself at this hearing. He is seeking relief from contiguous lot <br /> ownership and several variances in order to have this lot deemed buildable. The lot is <br /> located across from Jonas Drive on Cowit Road. Mr. Quinn describes the chain of deeds <br /> and ownership of the lot, which he has submitted for the record. The lot has been <br /> assessed and taxed as a separate and buildable lot. He is proposing a 2-bedroom house to <br /> be put in the back end of the lot. It is determined that Mr. Quinn will need: <br /> - a 57,380 square foot lot size variance <br /> - a 5.3 foot variance on each side <br /> - an 80 foot variance for frontage requirements <br /> Mr. Nelson moves to grant the above variances to Mr. Quinn. Zella Elizenberry seconds <br /> the motion. All agree. So moved. <br /> Emil R. and Alice J. Smith: Request a Variance from Section 174-31 of the Zoning By- <br /> laws to vary the front yard setback requirements and the side yard setback requirements <br /> in order to build a 7' x 13'6 addition on property located in an R-3 zoning district at 2 <br /> Pembroke Drive (Map 123 Parcel 73) Mashpee, MA. <br /> Sitting: James Regan, Robert Nelson and Zella Elizenberry. <br /> David Sanicki of Cape & Islands represents the petitioners. They are seeking variance <br /> relief in order to build a new entryway and replace the existing deck with an addition. <br /> Mr. Sanicki goes over the plans with the Board and discuss the requested variances. The <br /> proposed lot coverage will be 13.4%. Mr. Nelson moves to grant the following: <br /> - 5 foot variance on the side <br /> - 3 foot variance on the westerly side <br /> Ms. Elizenberry seconds the motion. All agree. So moved. Mr. Regan adds the <br /> topography of the lot and the fact that it is a corner lot in the Popponessett Overlay <br /> district is a factor in the granting of the variances. Reference criteria 1, 2 and 3 along <br /> with the plans from Cape & Islands. <br />
