Mashpee Zoning Paul and Angela Squarcia <br /> Board of Appeals V-03-138 <br /> 2 <br /> • GENERAL FINDINGS <br /> 1. that the subject property is located at 108 Wading Place Road and contains <br /> 17,000 square feet. <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> SPECIFIC FINDINGS <br /> 1. that relief may be granted without detriment to the public good. <br /> 2. that relief may be granted without derogating from the intent or purpose of the <br /> By-laws. <br /> 3. that there are circumstances relating to the shape and topography that affect <br /> the subject property and not the district in which it is located. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> applicant met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded, the Zoning Board of Appeals voted unanimously on November 12, <br /> 2003 to grant the following Variances: <br /> • 23,000 square feet on land space requirements. <br /> • 120.6 feet for frontage requirements. <br /> These Variances are granted in compliance with septic plans from Cape & Islands <br /> Engineering, Plan No. 5092303, File No. 109MA, dated September 23, 2003, revised <br /> October 6, 2003. <br /> 9Q �ZI <br /> Rd 81'AQN 88 <br /> d2d�d V,� N 0 01 <br />
