Mashpee Zoning Minutes—January 9, 2002 6 <br /> Board of Appeals <br /> told Mr. DiMeco "don't come to the Board of Appeals after you have flaunted the law— <br /> period". Mr. Borgeson attempted to make a motion to deny the Petition. <br /> Mr. Regan asked for Mr. Borgeson to delay the motion. Mr. Regan said that the plan was <br /> inadequate and asked Mr. DiMeco to submit a detailed plan that is legible and recordable. <br /> Mr. Regan said to "work out your problems with J". Mr. DiMeco asked if ZBA approval <br /> c`4 is required if the 8 parking spaces were installed according to the original site plan. The <br /> Board informed him that if the original plan had been adhered to, there would be no need <br /> I F z <br /> for the hearing. Mr. Brem said that homeowners purchased their units according to an <br /> original plan and that problems would ensue if the plan was modified. Mr. Brem said <br /> that the Building Commissioner is very busy and should not have to get involved in <br /> trivial issues that can be resolved with a little compromise. Mr. Brem informed Mr. <br /> DiMeco that he would personally be investigating the legitimacy of the Mercantile <br /> Property Management and its operation in Massachusetts. <br /> Mr. Regan moved to continue the Petition until March 13, 2002, subject to submission of <br /> a new plan or withdrawal of the Petition by February 13, 2002. (There was no second or <br /> agreement to the motion). <br /> James E. & Sandra L. Miles—Request a Special Permit under Section 174-25.A.8 <br /> of the Zoning By-laws for permission to construct an in-law apartment in the lower level <br /> of an existing dwelling on property located in an R-5 zoning district at 721 Main Street <br /> (Map 13 Parcel 50) Mashpee, MA. <br /> Sitting: James E. Regan III, Robert G. Nelson and Zella E. Elizenberry. Mr. Brem <br /> stepped down and left the room. <br /> Mr. Terry Luff, architect, represented the proposal and stated that the Petitioner's son and <br /> daughter-in-law plan to move into the lower level of the proposed new home. Plans call <br /> for construction of a 6-bedroom home on the large 2-acre lot. There is plenty of available <br /> room for parking. No Variance relief from the By-laws is being requested. Mr. and Mrs. <br /> Miles also attended the meeting. <br /> No comments were received from abutters. <br /> Mr. Nelson moved to grant the Special Permit. subject to the following: <br /> {:r <br /> • findings for in-law apartment (remove word "existing"). <br /> Terry Luff, Architect plan entitled `House Design for Mr. and Mrs. Miles @ Lot 50, <br /> Rt. 130 Main St., Mashpee, Mass., Date: 20 Oct.01' and Yankee Survey Consultants <br /> Foundation Certification, Job Number 52779 FND, Date: 10/25/01. <br /> Ms. Elizenberry seconded. All agreed. <br /> Patrick Williamson—Requests a Special Permit under Section 174-25.A.8 of the Zoning <br /> By-laws to allow for construction of an in-law apartment to an existing dwelling on <br /> property located in an R-5 zoning district at 713 Old Barnstable Road (Map 78 Parcel 70) <br /> Mashpee, MA. <br />
