Mashpee Zoning Minutes—January 9, 2002 7 <br /> Board of Appeals <br /> Patrick Williamson—Requests a Variance from Section 174-31 of the Zoning By-laws to <br /> vary the side setback requirements to allow for construction of an in-law apartment to an <br /> existing dwelling on property located in an R-5 zoning district at 713 Old Barnstable <br /> Road (Map 78 Parcel 70) Mashpee, MA. <br /> im Sitting: James E. Brem. <br /> Attorney Jeremy Carter represented nted the Petition and stated that plans call for removal of <br /> one of the existing bedrooms and relocation of it to the in-law apartment. The Petitioner <br /> plans to move his mother into the home. Mr. Williamson and his mother attended the <br /> meeting. <br /> A memo from the Board of Health dictates that the subject dwelling shall be restricted to <br /> a 3-bedroom home. <br /> Mr. Brem asked the nature of the hardship to justify granting of any Variance relief. Mr. <br /> Williamson said that the hardship was a financial consideration. Mr. Brem said that the <br /> Board can't grant Variance relief based purely on financial reasons. Mr. Nelson said that <br /> the addition could be moved over 1.7 feet and eliminate the need for Variance relief. <br /> Mr. Regan said that the location of the dwelling and an existing bulkhead and the sloping <br /> topography of the subject property dictate the location of the addition. Mr. Williamson <br /> said that he took great care in designing the addition and is only asking for a minimal <br /> amount of Variance relief. <br /> No comments were received from abutters. <br /> Mr. Brem moved to grant the Special Permit, subject to findings for in-law apartment and <br /> Atlantic Design Engineers, LLC plan entitled `Job Number 2191. Building Permit Plan of <br /> 713 Old Barnstable Road, Mashpee, MA, October 22, 2001, Prepared for Patrick and <br /> Jackie Williamson, 713 Old Barnstable Road, Mashpee, MA.'
