Mashpee Zoning Patrick Williamson V-02-5 2 <br /> Board of Appeals <br /> A memo from the Board of Health demands that the subject dwelling shall be <br /> restricted to a 3-bedroom home. Mr. Carter informed the Board that the proposal would <br /> remove one of the existing bedrooms in the home and relocate it to the in-law apartment. <br /> F <br /> No comments were received from abutters. <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine f <br /> that there are circumstances relating to the shape and topography which affect this lot and r <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> GENERAL FINDINGS <br /> ,: <br /> 1. that the subject property is located at 713 Old Barnstable Road and consists of ` <br /> n 16,265 square feet of land. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> k <br /> 1. the circumstances relating to the tapered shape and sloping topography affect <br /> s5} the subject lot and not the district in which it is located. <br /> 2. a literal enforcement of the By-laws would involve hardship to the Petitioner. <br /> 3 <br /> 3. relief may be granted without detriment to the public good. <br /> r 4. relief may be granted without derogating from the intent or purpose of the <br /> By-laws. <br /> F <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br /> F, made and seconded, the Zoning Board of Appeals voted unanimously on January 9, 2002 <br /> to grant a Variance of 1.7 feet to allow for construction of an in-law apartment to the <br /> t"y1t <br /> F existing dwelling on property located at 713 Old Barnstable Road. The Special Permit is <br /> conditioned upon compliance with Atlantic Design Engineers, LLC plan entitled `Job <br /> { Number 2191, Building Permit Plan of 713 Old Barnstable Road, Mashpee, MA., <br /> October 22, 2001, Prepared for Patrick and Jackie Williamson, 713 Old Barnstable Road, <br /> Mashpee, MA'. <br /> i <br /> aj <br />
