Mashpee Zoning Minutes—January 23, 2002 3 <br /> Board of Appeals <br /> Donato A. & Judith A. Federico —Request a Special Permit under Section 174-17 <br /> f the Zoning By-laws to allow for additions to a pre-existing, non-conforming dwelling <br /> on property located in an R-3 zoning district at 14 Seconsett Point Road (Map 124 <br /> Parcel 29) Mashpee, MA. <br /> Mr. Robert J. Stewart, builder for the project, asked for a continuance of the <br /> above-referenced Petition. The Board voted unanimously to continue the Petition <br /> until February 27, 2002. <br /> Paul L. & Kristen C. Hanlon—Request a Special Permit under Section 174-20 of the <br /> Zoning By-laws to allow for demolition of an existing structure and construction of a <br /> single-family home on property located in an R-3 zoning district at 51 Popponesset Island <br /> Road (Map 106 Parcel 13) Mashpee, MA. <br /> Paul L. & Kristen C. Hanlon—Request a Variance from Sections 174-31 and 174-33 of <br /> the Zoning By-laws to vary the lot coverage requirements and the setback requirements <br /> to water and wetlands to allow for construction of a single-family home on property <br /> located in an R-3 zoning district at 51 Popponesset Island Road (Map 106 Parcel 13) <br /> Mashpee, MA. <br /> Sitting: Edward M. Govoni, Robert G. Nelson and Frederick R. Borgeson. Mr. Regan <br /> stepped down and left the room. <br /> Mr. David Sanicki of Cape & Islands Engineering represented the Petition and stated that <br /> the proposal would exceed the allowed 20% lot coverage by a minimal .4%. The <br /> Conservation Commission has issued an order of conditions on the proposal, which <br /> would encroach on the setback requirements to water and wetlands by 9 feet. Mr. Brem <br /> questioned if the proposed lot coverage could be reduced. <br /> No comments were received from abutters. <br /> Mr. Govoni moved to grant a Variance of 9 feet from the setback requirements to water <br /> and wetlands and a Variance of.4% from the lot coverage requirements, subject to <br /> criteria, findings 1, 2, 3, 4, proposed construction is farther away from wetlands than <br /> existing structure, proposal would be an improvement with installation of a denitrification <br /> septic system. Mr. Nelson seconded. All agreed. <br /> Mr. Govoni moved to grant a Special Permit to allow for demolition of the existing <br /> structure on the subject property, subject to findings 2 through 12. Mr. Nelson seconded. <br /> All agreed. <br /> Casey Tree & Landscaping—Requests a Special Permit under Sections 174-25.D.1, <br /> 174-25.E.1, 174-25.E.8 and 174-25.G.6 of the Zoning By-laws to allow for construction <br /> of a commercial building with office, storage and warehouse space on properties <br /> located in a C-2 zoning district at 8 Sassacus Road and 84 Algonquin Avenue (Map 72 <br /> Parcel 58A and Map 72 Parcel 58B) Mashpee, MA.
