Mashpee Zoning Minutes—January 23, 2002 6 <br /> Board of Appeals <br /> The Conservation Commission has approved the proposal. <br /> No comments were received from abutters. <br /> Mr. Borgeson moved to grant the Special Permit, subject to findings 1, 2, 3, 4, 5. Mr. <br /> Brem seconded. All agreed. <br /> Robert Manning—Requests a Special Permit under Section 174-20 of the Zoning <br /> By-laws to allow for demolition of an existing structure and construction of a <br /> single-family home on property located in an R-3 zoning district at 21 Elliot Road <br /> (Map 118 Parcel 122) Mashpee, MA. Owner of record: Robert Wolf& Roger S. Wolf. <br /> Sitting: Edward M. Govoni, James E. Regan III and Frederick R. Borgeson. <br /> Mr. David Sanicki of Cape & Islands Engineering represented the Petition and stated that <br /> plans call for demolition of the existing structure and construction of a new home on the <br /> subject property. The Building Commissioner said that the subject property lies within <br /> the Popponesset Overly District and that the proposal does not really need a Special <br /> Permit from the ZBA. Mr. and Mrs. Manning also attended the meeting. <br /> The Conservation Commission has approved the project. <br /> Mr. Borgeson moved to grant the Special Permit, subject to findings 1 through 12. Regan I1I, Robert G. Nelson and Marshall A. Brem. <br /> Attorney Kevin M. Kirrane represented the Petitioner, Mr. and Mrs. Dougherty, both of <br /> whom also attended the meeting. Attorney Kirrane stated that plans call for construction <br /> of a garage on the subject property that would house the Petitioner's vehicles and boats. <br /> He submitted a letter from Mr. Paul Jacobson, an abutter at 196 Ninigret Avenue, <br /> expressing approval of the proposal. Attorney Kirrane said that the subject property was <br /> created sometime in the 1940's or 1950's, prior to the adoption of Zoning in the Town. <br /> The subject property has been held in separate ownership from all the other adjacent <br />
