i <br /> I I r <br /> Mashpee Zoning Terry Luff SP-02-33 3 <br /> Board of Appeals Vida#2 Trust <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. the proposed use and development are consistent with applicable law, rules <br /> and regulations. <br /> 2. there will be no adverse effect on public health or safety. <br /> Y <br /> 3. there will not be an excessive demand upon community facilities created as a <br /> result of the proposal. <br /> 4. there will not be a significant adverse impact on the environmental factors <br /> listed in Section 174-24.C.2. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded, the Zoning Board of Appeals voted unanimously on February <br /> 27, 2002 to grant a Special Permit under Section 174-25.G.5, 174-25.G.6 and 174-25.G9 � <br /> on the subject property. The Special Permit is conditioned upon compliance with the <br /> following: <br /> 1. that the request for `retail/office space' shall be removed from the Petition and <br /> from the proposal. <br /> 2. Cape & Islands Engineering plan entitled `Proposed Site Plan Located in + <br /> Mashpee, Mass., Prepared for Terry Luff, Date: Dec 16,2001, Jan.29,2002'. <br /> 3. Terry Luff, Architect plan entitled `Mashpee Industrial Bays, Inc. Lot 3 <br /> Nicolettas Way, Mashpee, Mass., Site Plan& Building Plan&Elevations, II <br /> Date: 30 Nov 01, Rev 1: 16 Jan 02' and stamped `Design Review approved <br /> 1/16/02, w/notations'. <br /> 4. before an occupancy permit will be issued,the Design Review Committee <br /> must visit the subject property and confirm that the Petitioner complies with <br /> all the requirements of the Design Review Committee concerning the building <br /> and landscaping. <br /> 5. before an occupancy will be issued the Petitioner must <br /> comply with all <br /> _ <br /> requirements ements of the Technical Review Committee. <br /> I <br /> ,I <br /> I <br /> I ' <br />
