Mashpee Zoning Minutes—March 27, 2002 6 <br /> Board of Appeals <br /> Mr. Brem questioned who would be responsible for policing the situation. Mr. Sanicki <br /> said that the Conservation Commission and the Harbormaster addressed this question at <br /> the Conservation hearings. Mr. Sanicki noted that the policing of the situation is really `a <br /> fisherman's friend type thing' and that if there are problems,Yp g p , people should feel free to <br /> call the Police Department. Mr. Sanicki said that he is not sure of the specifics of how <br /> the Town's Harbormaster plans to enforce rules for use of the dock. Mr. Brem said that <br /> he was under the impression that a house had to be present on a property before <br /> construction of a dock was permitted. Mr. Sanicki replied that the subject property is a Ill i i 1 <br /> Town-owned piece of property, on a Town landing, a Town project and a Town facility <br /> for the general public. <br /> 1 IN <br /> �� ilii, III <br /> Mr. Brem said that he lived in a gated community with a dock and that he encountered A 11 <br /> problems on the weekend when people would tie up their boats at the dock and prevented <br /> other boaters from docking. The Board went into a lengthy discussion on the possible <br /> problems regarding abuse of the dock and how rules would be enforced. Ms. Elizenberry <br /> said that the Board does not have the responsibility to render decisions about policing, ii it <br /> but that the Board should be sensitive to the effect that decisions have on the Town and j <br /> its residents. She suggested that the Board continue the Petitions until the Harbormaster <br /> � I <br /> could be present at the hearing. Messrs. Guerrera and Brem agreed with her suggestion. � <br /> Mr. Sanicki said that the Harbormaster is a Town employee and that the Conservation II <br /> Commission has approved the project. Mr. Borgeson concluded the discussion by saying <br /> that he had no problem with the proposal. He stated those problems with parking and <br /> docking may arise; however, those issues do not come under the scope and authority of <br /> the Board. Mr. Borgeson said that the Board has jurisdiction to grant or deny a request <br /> for a Special Permit or a Variance, but does not have the authority to guarantee or enforce <br /> use of a particular structure. <br /> I I <br /> I <br /> I I'i II' <br /> Mr. James J.
