• i <br /> Mashpee Zoning Minutes—April 24, 2002 2 <br /> Board of Appeals <br /> The Conservation Commission has approved the project. �I <br /> Mr. Regan commented that the original Special Permit for the subject property consists <br /> of one page and would be considered inadequate by today's standards. He expressed <br /> concern with the parking issue, signage and the long-term plan for the subject property. <br /> Mr. Leedham stated that the congested parking issue has been a long-standing problem <br /> for the neighborhood. He said that he met with the neighbors and addressed their <br /> concerns. Mr. Leedham said that he plans to have `the main operation, the crux of the <br /> retail operation' at Bosun's Marine on Route 28 and that the property located on Frog <br /> Pond Close would be a `satellite to Bosun's Marine'. This would allow for consolidation <br /> of deliveries, orientations, demonstrations, etc. Mr. Leedham said that his legal counsel <br /> has developed a comprehensive set of rules and regulations for anyone contracting to use <br /> the Marina. Some of those rules include the following: j <br /> No parking on the streets would be allowed. I� <br /> No unleashed pets. Ili <br /> No trash on the ground. <br /> No dumping of waste in the water. <br /> No commercial vehicles, trailers or RV's would be allowed. <br /> Mr. Leedham said that he has been a member of the community for over 17 years and has <br /> a sense of responsibility as a local homeowner and owner of a business to clean the <br /> subject property and make it safe to use. Mr. Leedham said that violation of the lease ll j <br /> agreement would result in its cancellation and the offending party would be removed (I <br /> from the subject property. Mr. Borgeson said that he visited the site and agreed that the <br /> bulkhead is in need of repair and that the proposal would be an improvement to the i <br /> subject property and to the neighborhood. <br /> I'. <br /> Mr. Nelson asked if the proposal requires permission from the Corps of Engineers. Mr. <br /> Sanicki said the bulkhead is permitted, whichermit allows for maintenance ce of the <br /> bulkhead. Mr. Sanicki said that he is awaiting an answer from the Corps of Engineers. <br /> Mr. Guerrera asked for a copy of the rules and regulations of the lease agreement. Mr. II <br /> Sanicki submitted a copy of the `Mashpee Neck Marina, Inc. Dockage/Mooring Contract <br /> Rules &Regulations 2002'. <br /> No comments were received from abutters. <br /> I <br /> i <br /> Mr.Nelson moved to grant the Special Permit, subject to the following: f <br /> • findings for docks 1, 2, 3, 4, 5, 6 - change word `dock' to bulkhead. <br /> • Cape & Islands Engineering plan entitled `Proposed Bulkhead&Ramp <br /> Reconstruction Located in Mashpee, Mass., Prepared for Mashpee Neck Marina, <br /> Inc., Date: Mar.20,2002, Rev'd 4/1/02'.• !L <br /> conditioned upon verification of DEQE license 1039 allowing for proposed work <br /> to be done. <br /> Mr. Regan seconded.
