Mills of Mashpee, I ' <br /> Massachusetts for a Special Permit under Section 174-25.A.8 of the Zoning By-laws <br /> to allow for an in-law apartment in an existing dwelling on property located in an R-5 <br /> zoning district at 5 Wilann Road (Map 46 Parcel 9) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General i <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on May 3 and May 10, 2002, <br /> a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on ! IIS <br /> Wednesday, May 22, 2002, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III <br /> and Zella E. Elizenberry. ! it <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of I! <br /> Mashpee Zoning By-laws. <br /> Mr. Regan announced that this is a Chapter 112 hearing. Ms. Mills and Mr. <br /> III <br /> Caesar Pineda represented the Petition and submitted photos of the dwelling and plans of j <br /> the proposed final construction. Building Commissioner Russell W. Wheeler explained ;III I, <br /> that the Petitioner is seeking to legalize the in-law apartment, which has already been <br /> constructed on the second floor. <br /> The Board of Health memo indicates that the subject property is located in Zone <br /> SII <br /> 11 and is limited to the existing number of three bedrooms. <br /> No comments were received from abutters. <br />
